Your letter dated December 12, 1983, took exception to our Class III fee de termination made in accordance with 10 CFR 170.22 for the review of Proposed Change No. 123 dated September 9, 1983, for Unit No. I of the San Onofre Nuclear Generating Station. When the application was filed, your Company took the position that no fees were due because NRC requested these changes to the Technical Specifications (TS) on purging and venting of the contain ment to clarify the TS for NRC's convenience. Our November 15, 1983 letter requested the Class III fee because the Division of Licensing (DL) staff informed us that the review for San Onofre Unit No. I involved a single safety issue. Your Company's December 12 letter stated that since the TS changes submitted on September 9 conform to the NRC's request and are con sistent with the draft safety evaluation of February 17, 1982, the TS review will not involve consideration of a safety issue.

On February 17, 1984, the DL staff completed their review of Proposed Change No. 123 and issued Amendment No. 71 to License No. DPR-13. In approving the TS changes, the safety evaluation issued with Amendment No. 71 took into con sideration the review addressed in the February 17, 1982 safety evaluation for the facility. This action, which took into consideration the 1982 eval uation, completed the San Onofre Unit No. I review on "lock closed, 24-inch purge line isolation valves" which was part of the generic issue on purging and venting of containments that began in November 1978.

In conclusion, it is the DL staff's final position that the previously deter mined Class III fee is appropriate for the review of this aspect of the San Onofre Unit No. I purging and venting of containment because the review in volved a safety issue.
