We have received a copy of your application dated September 9., 1983,, which was filed with the Office of Nuclear Reactor Regulation (ONRR) for review.

This application pro osed Technical Specification Change Nos. 123 (contain ment isolation valves) and 124 (containment systems) for the San Onofre Nuclear Generating Station Unit No. 1. Fees pursuant to 170.22 were not remitted with your application since your Company determined that these changes are exempt from fees because they result from independent written Commission requests for the application, clarify the technical specifica tions, and are issued for the convenience of the Commission.

Based on information provided by the ONRR staff, it has been determined that a Class III fee ($4,000) is appropriate for Proposed Change No. 123 since the review will involve consideration of a single safety issue.

When applications are requested by the NRC to clarify or simplify the I cense or Technical Specifications for the convenience of the NRC and have minor safety significance, they are exempted from fees under the provisions of Footnote 2 of 10 CFR 170.22. To qualify for the exemption, applications must meet all of these criteria. Although your application resulted from an NRC request, it is our understanding that it was necessary to minimize purge and vent operations to assure that LOCA site boundary doses do not exceed the 10 CFR Part 10Q Timits. Therefore, it is not exempt from fees.

Fees are not applicable for Proposed Change No. 124 since this submission superseded a pending prefee filing dated December 3, 1975.

In summary, you are te.nsted to remit the sum of $4,000 to this office for Proposed Change No. 123. If the ONRR staff's final review of this change reveals that this fee is not appropriate, you will be notified and any necessary adjustments will be made.
