By Proposed Change No. 108 dated January 5, 1982, your Company requested Technical Specification changes which would permit raising the allowable phosphate discharge limit for San Onofre Unit No. 1. A Class III fee of
$4,000 was remitted by your letter dated July 27, 1982, for this applica tion to comply with 10 CFR 170.22.
By letter dated March 11, 1983, the Division of Licensing (DL) staff issued Amendment No. 67 to Provisional Operating License No. DPR-13. In this letter, the DL staff stated that your January 5, 1982 application is no longer applicable and will not be reviewed. Although 10 CFR 170.12(a) permits the retention of fees for such applications, it is our policy to exempt these applications from fees when no review is necessary and review did not commence. Therefore, we have concluded that an exemption pursuant to 10 CFR 170.11(b) from the fee requirements is hereby authorized by law, and such exemption is otherwise in the public interest and is hereby grant ed for this application. Accordingly, we are concurrently authorizing the Division of Accounting and Finance to refund $4,000 to your Company. Re funds are generally processed within a two-week period.
