KEWAUNEE POWER STATION - RESPONSE TO REQUEST FOR RELIEF FROM RESPONDING FURTHER TO THE MARCH 2012 REQUEST FOR INFORMATION LETTER FOR RECOMMENDATIONS 2.1 AND 2.3, AND STATUS OF 60-DAY RESPONSE TO ISSUANCE OF SEISMIC EVALUATION GUIDANCE RELATED TO THE NEAR-TERM TASK FORCE RECOMMENDATION 2.1, SEISMIC
Dear Mr. Heacock:
By letter dated March 12, 2012,1 the Nuclear Regulatory Commission (NRC) issued a request for information per Title 10 to the Code of Federal Regulations, Section SO.S4(f) (referred to as the SO.S4(f) letter), to all nuclear power reactor licensees and construction permit holders in response to lessons-learned from Japan's March 2011, earthquake and subsequent tsunami.
Enclosures 1 through 4 to the SO.S4(f) letter include Recommendations 2.1 and 2.3 for seismic and flooding hazard actions, as part of the response to the Near-Term Task Force [NTTFJ Recommendations for Enhancing Reactor Safety in the 21st Century report, issued July 12, 2011.2 The SO.S4(f) letter requested licensees, in part, to perform seismic and flooding walkdowns and reevaluate the seismic and flooding hazards for their facilities.
On February 2S, 2013, Dominion Energy Kewaunee (DEK) submitted a letter3 to the NRC stating its intention to cease operation of Kewaunee Power Station (Kewaunee) on May 7, 2013, per 10 CFR SO.82(a)(1 )(ii). In response to the 50.54(f) letter, Enclosure 1, Required Response, item 1, DEK submitted an April 29, 2013, letter4, stating that Kewaunee will no longer be authorized to operate the reactor once fuel is removed from the reactor vessel. Further, it stated that once a certification of permanent removal of fuel is submitted to the NRC, Kewaunee will be in a permanently shutdown and defueled condition and the obligations of the SO.S4(f) letter will no longer apply. DEK therefore requested to be relieved from responding further to the SO.S4(f) letter.
By letter5 dated May 14, 2013, DEK submitted a certification of permanent removal of fuel from the Kewaunee reactor vessel per 10 CFR SO.82(a)(1}(ii).

- 2 The NRC staff considers the DEK request to be an acceptable response to the 50.54(f) letter,, Required Response, item 1. Further, DEK is no longer obligated to respond to Enclosures 1 through 4 of the 50.54(f) letter, since Kewaunee is no longer an operating reactor.
This letter serves as an acknowledgement of receipt of your Enclosure 1, item 1, response and relieves you from further obligations associated with the seismic and flooding actions in Enclosures 1 through 4 of the 50.54(f) letter. The staff is evaluating DEK's request for relief from the obligations associated with Enclosure 5, Recommendation 9.3: Emergency Preparedness. Until the NRC issues its determination formally, DEK should proceed with the actions associated with Enclosure 5.
