On March 12, 2012, the Nuclear Regulatory Commission (NRC) issued Reference I to all power reactor licensees and holders of construction permits in active or deferred status. Enclosure 1 of Reference 1 contains specific Requested Actions, Requested Information, and Required Responses associated with Recommendation 2.1, Seismic Evaluations. Reference 1 requires a "60-day response" in which each addressee must submit: (1) its intent to follow the developed guidance, or (2) an alternative approach including acceptance criteria. In accordance with Reference 2, the 60-day response is due to NRC by April 29, 2013.

By letter dated February 25, 2013, Dominion Energy Kewaunee (DEK) informed the NRC of its intention to permanently cease operation of Kewaunee Power Station (KPS) on May 7, 2013 (Reference 2). Subsequently, by separate letters dated February 26, 2013 (References 3 and 4), DEK submitted an update to the KPS Irradiated Fuel Management Plan (as required by 10 CFR 50.54(bb)) and a PSDAR (as required by 10 CFR 50.82(a)(4)(i)).

After fuel is removed from the reactor vessel and DEK dockets a certification of permanent removal of fuel from the reactor vessel pursuant to 10 CFR 50.82(a)(1)(ii), the 10 CFR Part 50 license for KPS will no longer authorize operation of the reactor or emplacement or retention of fuel into the reactor vessel, as specified in 10 CFR 50.82(a)(2).

The recommendations in Reference 1 are intended for operating units. As Reference 1 indicates, "Operatingpower reactor licensees under 10 CFR Part 50 are required to respond to all of the information requests." The list of licenses to which Reference 1 applies does not include permanently shutdown units. Since KPS will soon be a non-operating licensee in a permanently shutdown and defueled condition, DEK does not plan on implementing the

Further, KPS requests that the NRC relieve KPS from the obligation of responding further to Reference 1 after KPS certifies that fuel has been permanently removed from the reactor vessel, thus treating KPS in the same manner as other permanently shutdown units.
