By letter dated July 8,2009, as supplemented by letters dated September 28,2009, October 26, 2009, October 5,2010, October 28,2010, July 28,2011! August 23,2011, October 28,2011!
December 15, 2011, January 11,2012, March 2,2012, and April 23, 2012, Entergy Nuclear Operations,lnc. (Entergy) submitted a license amendment request for Indian Point Nuclear Generating Unit Nos. 2 and 3 to the U.S. Nuclear Regulatory Commission (NRC) staff for review.
Enclosed for your review and comment is a copy of the NRC staff's draft safety evaluation (SE) for the license amendment request.
Pursuant to Section 2.390 of Title 10 of the Code of Federal Regulations (10 CFR), we have determined that the enclosed draft SE contains proprietary information, as indicated by double brackets. We will be issuing a non-proprietary version of the SE, without the information enclosed by double brackets. However, we will delay the public issuance of the non-proprietary SE for a period of 10 working days from the date of this letter to provide you with the opportunity to comment on any proprietary aspects. If you believe that any information in the enclosure is proprietary, but is not properly identified by brackets, please identify such information and define the basis pursuant to the criteria of 10 CFR 2.390. The final non-proprietary and proprietary SEs will be issued after making any necessary changes. The final non-proprietary SE will be made publicly available. The NRC staff's disposition of your comments on the draft SE will be discussed in the final SE.
To facilitate the NRC staff's review of your comments, please provide a marked-up copy of the SE showing proposed changes and provide a summary table of the proposed changes.
