CLOSURE OF DECOMMISSIONING FUNDING STATUS REPORT REVIEWS FOR INFORMATION PROVIDED AS OF DECEMBER 31, 2010 In 1988, the U.S. Nuclear Regulatory Commission (NRC) established requirements to assure that decommissioning of all licensed facilities will be accomplished in a safe and timely manner and that adequate licensee funds will be available for this purpose. The requirements for reactor licensees are stated in Title 10 of the Code of Federal Regulations (10 CFR) Sections 50.33(k), 50.75, and 50.82. Reactor licensees must certify they provide not less than a minimum prescribed amount of financial assurance for decommissioning. The amount to be provided must be adjusted annually to account for cost escalation.
Pursuant to 10 CFR Section 50. 75(f)(1), all licensees are required to submit a Decommissioning Funding Status (DFS) report at least once every 2 years in order for the NRC to obtain the information necessary to monitor the status of decommissioning funds. The Office of Nuclear Reactor Regulation's (NRR's) Office Instruction LlC-205, Revision 4, "Procedures for NRC's Independent Analysis of Decommissioning Funding Assurance for Operating Power Reactors,"
dated December 2010 (Agencywide Documents Access and Management System (ADAMS)
Accession No. ML103410283), describes the analysis performed by the NRC staff to determine if the licensee has provided adequate decommissioning financial assurance.
Consistent with 10 CFR 50.75(f)(1), all licensees for operating nuclear reactor power plants submitted DFS reports in March 2011, reflecting December 31, 2010, information. The NRC staff reviewed the information in the DFS reports for all 104 operating nuclear power reactors.
In addition, to facilitate the NRC staffs review of the reports, supplemental information was provided by many licensees in response to NRC staff requests for additional information (RAls).
Based on the information provided in the DFS reports, as well as the supplemental responses to the RAls, the NRC staff completed all reviews reflecting December 31, 2010, information. A summary of the staffs reviews can be found in SECY 049. "Summary Findings Resulting from the Staff Review of the 2010 Decommissioning Funding Status Reports for Operating Power Reactor Licensees;' dated October 26, 2011 (ADAMS Accession No. ML112620046).
