Leslie, As we discussed this morning, the NRC staff has reviewed you responses to the I&C and Fire Protection questions from a submittal dated November 1, 2011. for docket STN 50-456 entitled

'Additional Information Supporting Request for License Amendment Regarding Measurement Uncertainty Recapture Power Uprate' for docket STN 50-456 entitled 'Additional Information Supporting Request for License Amendment Regarding Measurement Uncertainty Recapture Power Uprate'.

We need written confirmation regarding your response as indicated in the highlighted text as we discussed in our conference last month:

Fire Protection RAI #5 The staff notes that the license amendment request (LAR), Attachment 5, MUR Technical Evaluation,Section VII.6.A, Fire Protection Program, on page VII-5 states that, an analysis of the change in combustible loading determined that the overall increase in fire loading is small and does not change the fire load classification of each affected fire zone It is unclear to the staff whether there are fire protection program plant modifications planned (e.g., adding new cable trays, or re-routing of existing cables) at MUR power uprate conditions.

Clarify whether this request involves plant modifications, or changes to the fire protection program. If any, the staff requests the licensee to identify proposed modifications and discuss the impact of these modifications on the plants compliance with the fire protection program licensing basis, Title 10 of the Code of Federal Regulations, Section 50.48, or applicable portions of Branch Technical Position (BTP) CMEB 9.5-1.

Exelon Response The MUR-PU LAR (Reference 1) does not involve plant modifications to the fire protection system, or changes to the fire protection program. The Leading Edge Flow Meter (LEFM) modification adds small amounts of combustible material in the form of instrumentation, control and power cable insulation to twelve (12) Braidwood Unit 2 fire zones, seven (7) Byron Unit 1 fire zones, and seven (7) Byron Unit 2 fire zones. The Braidwood Unit 1 LEFM modification is still under development. The Fire Protection Report (FPR), Section 2.3, currently lists cable insulation as a fire hazard in the affected fire zones and, therefore, the LEFM installation does not introduce a new fire hazard in these fire zones. The change in combustible loading is well within the available combustible loading margins The other modifications associated with the MUR-PU and the Steam Generator Tube Rupture (SGTR) and Margin to Overfill (MTO) are currently under development and will be installed in accordance with 10 CFR 50.59. The impact of these modifications on the fire protection program will be evaluated in accordance with Exelons design change process.

Follow-up Request Staff notes that modifications associated with the SGTR and MTO have not yet been completed to address the impact on the fire protection program. The NRC staff requests the licensee discuss how the results of modifications associated with the SGTR and MTO would impact the fire protection program and the plants compliance with the fire protection program licensing basis, 10 CFR 50.48, or applicable portions of BTP CMEB 9.5-1, at the EPU conditions.

Confirm how will the licensee will ensure that, once developed and implemented, the modifications will not change this impact.

Your letter to us is requested within 2 weeks of this email, by March 21, 2012, to allow the review adequate time to review for the Safety Evaluation.
