Oconee Nuclear Station, Units 1, 2, and 3 Docket Nos. 50-269, 50-270, and 50-287 Relief Request Serial #09-GO-001 Request for NRC Clarification By letter dated February 17, 2010 (Agencywide Document Access and Management System (ADAMS) Accession No. ML100471112), the NRC provided a Safety Evaluation for the subject request. As the result of subsequent review of the Safety Evaluation, Duke Energy determined that clarification is needed to resolve the following issue, prior to using the approved alternative.

In Section 4.0 of the Safety Evaluation, the NRC stated that "the licensee will also perform a visual examination of the ground surface areas above buried components to detect any evidence of through-wall leakage".

It is Duke Energy's position that visual examinations prescribed by our proposed alternative do not apply to components that are encased in concrete or are located beneath the foundations of plant structures. During a conference call on December 14, 2011, NRC staff agreed with this position. Duke Energy requests NRC to confirm by letter that this position is consistent with the NRC Safety Evaluation.

A response to this request would be appreciated by April 1, 2012.
