ME6829 - Acceptance of FCS Exmption Request from Biennial Emergency Preparedness Exercise Requirement

Bill, By letter dated July 29, 2011, Omaha Public Power District (OPPD) submitted a one-time exemption request from the requirements of Appendix E, Sections IV.F.2.b and c of Section 50 of Title 10 of the Code of Federal Regulations (10 CFR), regarding the conduct of a biennial full participation emergency preparedness exercise in 2011 at Fort Calhoun Station, Unit No.1 (FCS) . This scheduler exemption is being requested as a result of Missouri River flooding conditions. OPPD states that flood conditions have had a great impact on the emergency management agencies in Nebraska, Iowa and local communities. OPPD's next biennial exercise is scheduled for October 18, 2011. This exemption will allow OPPD to conduct a biennial exercise of the FCS emergency plan in calendar year 2012 on a date that is agreeable between OPPD, the Nuclear Regulatory Commission (NRC), the Federal Emergency Management Agency (FEMA), and other affected offsite agencies.

The purpose of this letter is to provide the results of the NRC staff's acceptance review of this exemption request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed exemption in terms of regulatory requirements and the protection of public health and safety and the environment. Please note, if the NRC staff has determined a need for substantive requests for additional information (RAIs) to complete the technical review, you will be advised of these RAIs by separate correspondence.
