By letter dated May 18, 2011 (TAC Nos. ME6269 - ME6287), Exelon Generation Company, LLC (Exelon Generation) requested the Nuclear Regulatory Commission (NRC) staff to make a threshold determination that the proposed indirect transfer of control of the NRC licenses held by subsidiaries of Constellation Energy Nuclear Group, LLC does not involve a direct or indirect transfer of control of the licenses held by Exelon Generation.
The purpose of this e-mail is to provide the results of the NRC staffs acceptance review of this request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review.
The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.
The NRC staff has reviewed the letter and Reference 1 within the letter, Application for Approval of Indirect Transfer of Control of Licenses, dated May 12, 2011, and concluded that it provides technical information in sufficient detail to enable the staff to complete its detailed technical review and make a threshold determination regarding the Exelon Generation licenses.
Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. If additional information is needed, you will be advised by separate correspondence.
