CRYSTAL RIVER UNIT 3 NUCLEAR GENERATING PLANT LICENSE RENEWAL ENVIRONMENTAL REVIEW (DHR NO. 2009-2164)

Dear Mr. Gaske:

The U.S. Nuclear Regulatory Commission (NRC) is conducting an environmental review of the effects of renewing the Crystal River Unit 3 Nuclear Generating Plant (CR-3) operating license.

CR-3, located in Citrus County, Florida, approximately 80 miles north of Tampa, is operated by Florida Power Corporation. As part of the environmental review, the NRC has prepared a draft Supplemental Environmental Impact Statement (SE/S) to NRC's "Generic Environmental Impact Statement for License Renewal of Nuclear Plants," NUREG-1437. The SEIS includes the results of a site-specific analysis of environmental impacts of license renewal at CR-3, including potential impacts to historic properties. A copy of the draft SEIS is enclosed. Pursuant to 36 CFR 800.8(c), we are requesting your comments on the draft SEIS and on our preliminary conclusions regarding potential impacts to historic properties.

As explained in our letter dated April 10, 2009, the NRC determined that the area of potential effect (APE) for this license renewal action (the undertaking) is the CR-3 power plant site, transmission lines, and immediate environs. This determination is made irrespective of ownership or control of the lands of interest.

NRC technical staff toured the CR-3 site and reviewed historic and archaeological records. The NRC also contacted three Native American Tribes identified as having potential interest in the proposed undertaking. To date, no comments have been received.

In the context of the National Environmental Policy Act of 1969, under which the draft SEIS was prepared, the NRC's preliminary determination is that any impact from continued power plant operations and maintenance activities during the license renewal term on historical and archaeological resources located in the APE would be small. Under the provisions of the National Historic Preservation Act of 1966, the NRC also determined that historic properties would not be adversely affected by this undertaking (the renewal of the CR-3 operating license).

The justification for this conclusion is explained in Section 4.9.6 which begins on page 4-53 in the draft SEIS.
