UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 June 2, 2011 Mr. David Atherholt Manager - Site Regulatory Affairs Exelon Nuclear Three Mile Island Nuclear Station P. O. Box 480 Middletown, PA 17057

SUBJECT:

THREE MILE ISLAND NUCLEAR STATION, UNIT 1 REQUEST FOR RETURN OF DOCUMENT SUBMITTED TO NUCLEAR REGULATORY COMMISSION DOCUMENT CONTROL DESK

Dear Mr. Atherholt:

By transmittal dated December 6,2010, the Records Management Department of Three Mile Island Nuclear Station, Unit 1 (TMI-1), submitted a copy of the Exelon Generation Company, LLC, (Exelon) Quality Assurance Topical Report (QATR), NO-AA-10, Revision 85, to the U.S.

Nuclear Regulatory Commission (NRC) Document Control Desk (DCD). The DCD identified a page numbering discrepancy in Appendix A of the submittal, prior to processing the QATR into the NRC's Agencywide Documents Access and Management System (ADAMS). By letter dated May 4,2011 (ADAMS Accession No. ML11126A312), after verbal discussions of the discrepancy between the NRC staff and Exelon, Exelon determined that the QATR submittal dated December 6,2010, was not required by regulation and requested its return. Specifically, Exelon determined that a fleet QATR, applicable to TMI-1, is submitted separately, in accordance with the requirements of Title 10 of the Code ofFederal Regulations Paragraph 50.54(a)(3).

Enclosed please find the requested document. Based on your withdrawal request, the version of the QATR submitted December 6,2010, has not been entered into ADAMS. The NRC understands that the QATR discrepancy has been entered into your corrective action program under issue report number 1201371.

Please contact me at 301-415-2833, if you have any questions.
