RHODE ISLAND ATOMIC ENERGY COMMISSIONREQUEST FOR AN EXTENSION TO COMPLETE THE RESPONSES TO THE NRC REQUEST FOR ADDITIONAL INFORMATION REGARDING THE RHODE ISLAND NUCLEAR SCIENCE CENTER REACTOR LICENSE RENEWAL (TAC NO. ME1598)

Dear Dr. Tehan:

The U.S. Nuclear Regulatory Commission (NRC) received your letter dated May 18, 2010 (Agencywide Document Access and Management System (ADAMS) Accession Number ML101620129), requesting additional time to complete the responses to the request for additional information (RAI) described in NRC letter dated April 13, 2010 (ADAMS Accession Number ML100360106). I have reviewed your extension request and agree for the following reasons: 1) it is your first request; 2) there were a large number of complex questions requiring significant analyses; and, 3) more notably, you have demonstrated sustained progress in completing the RAI responses, and maintained good communication with the NRC regarding the status of your RAI response efforts.

As we discussed during our recent phone conversations, the new date for the completion of the RAI responses is September 30, 2011. Given the length of the extension, it is expected that you continue to demonstrate sustained progress toward completion of the RAI responses during the period of the extension. It is also expected that you continue to periodically communicate your intended response schedule and inform the NRC of any potential schedule impacts in a timely manner.

As stated in the enclosure to the letter dated April 13, 2010, your complete response to the RAI must include a response to each individual question and a set of revised technical specifications that incorporate any changes made as a result of the responses to the individual questions. In accordance with Title 10 of the Code of Federal Regulations (10 CFR), Section 50.30(b), you must execute your response in a signed original under oath or affirmation. Your response must be submitted in accordance with 10 CFR 50.4, Written Communications. Information included in your response that is considered security, sensitive, or proprietary, that you seek to have withheld from the public, must be marked in accordance with 10 CFR 2.390, Public inspections, exemptions, requests for withholding.
