SAN ONOFRE NUCLEAR GENERATING STATION, UNITS 2 AND 3 WITHDRAWAL OF AMENDMENT REQUESTS FOR APPROVAL OF REVISED TECHNICAL SPECIFICATION FOR MOVEMENT OF FUEL ASSEMBLIES (TAC NOS. ME3136 AND ME3137)

Dear Mr. Dietrich:

By letter dated January 14, 2010 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML100210200), Southern California Edison (SCE) applied for amendments to Facility Operating License Nos. NPF-10 and NPF-15 for the San Onofre Nuclear Generating Station (SONGS), Units 2 and 3, respectively. The proposed amendments would have revised a number of Technical Specification (TS) requirements, to impose similar restrictions on the movement of non-irradiated fuel assemblies to those currently in place for movement of irradiated fuel assemblies. The additional restrictions would limit the movement of all fuel assemblies over irradiated fuel assemblies in containment or in the fuel storage pool.

Subsequently, by letter dated January 27, 2011 (ADAMS Accession No. ML110280380), SCE withdrew the license amendment request (LAR). The Nuclear Regulatory Commission (NRC) staff acknowledges your request to withdraw the application; staff review activities have ceased and Technical Assignment Control (TAC) numbers ME3136 and ME3137 have been closed.

Notice of Consideration of Issuance of the proposed amendment was published in the Federal Register on May 18, 2010 (75 FR 27832). Therefore, the NRC staff has filed the enclosed Notice of Withdrawal of Application for Amendment to Facility Operating License with the Office of the Federal Register for publication SCE submitted this LAR in accordance with NRC Administrative Letter (AL) 98-10, "Dispositioning of Technical Specifications that are Insufficient to Assure Plant Safety," following your staff's determination that the current SONGS TSs are non-conservative regarding handling of non-irradiated fuel assemblies. Based on the guidance in that AL, the SONGS staff has been managing this situation using administrative controls, as described in your LAR dated January 14, 2010. In your withdrawal letter, you indicated that SCE intends to submit a revised LAR with additional information later this year. The NRC staff supports the prompt resolution of the identified non-conservative TS and is willing to meet with SCE on this subject prior to your submittal of a revised LAR.

NPF-10 and NPF-15 for the San Onofre Nuclear Generating Station (SONGS), Units 2 and 3, respectively, located in San Diego County, California.

The proposed amendments would have revised a number of Technical Specification (TS) requirements, to impose similar restrictions on the movement of non-irradiated fuel assemblies to those currently in place for movement of irradiated fuel assemblies. The Commission had previously issued a Notice of Consideration of Issuance of Amendment published in the FEDERAL REGISTER on May 18, 2010 (75 FR 27832). However, by letter dated January 27, 2011, the licensee withdrew the proposed changes.
