10CFR2.206 Request from September 17, 2010
- Jim, Per our discussion this afternoon, I do not believe that within the next 30 days I will be able to assemble additional information regarding the inadvertent passive reactor shutdown which occurred at Callaway Plant on October 21, 2003. All the information I had regarding the incident was provided to Region IV prior to their February 2010 close out of the allegation. Although I do not believe that Region IV adequately addressed all the information I provided them and although I believe that Region IV is intentionally refraining from developing an opinion on certain aspects of the event (such as whether or not prior to the 11:25 am alarm the operators were aware the reactor had passively shut down, whether or not the Operations Manager was in the Main Control Room during the event, etc.), I recognize that per MD 8.11 you are allowed to close my 10CFR2.206 petition to the allegation process based on the fact that no new information was provided and regardless of whether or not the allegation process considered all the original information provided to them.
Although I would like a chance to provide further information to the Petition Review Board, I will not be able to assemble that information within the next 30 days. At this time, I am unable to provide you a time table for when I might have additional information to present. I recognize that MD 8.11 allows you to close my petition at this point.
