REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (TAC NO. ME4721)

On January 6, 2011, you submitted a letter on behalf of Union Electric Company, d/b/a Ameren Missouri, owner of Callaway Plant, Unit 1, requesting that the Nuclear Regulatory Commission (NRC) should withhold information contained in the following document from public disclosure, pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Part 2, Section 2.390:

Ameren Missouri Response to September 17,2010, 10 CFR 2.206 Petition Filed by Lawrence S. Criscione The reason for requesting NRC's withholding of this information was that the letter was confidential information submitted under 10 CFR 2.390.

On February 23, 2011 (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML110550375), I requested that, in accordance with the provisions of 10 CFR 2.390, you submit to NRC an affidavit pursuant to 10 CFR 2.390, seeking non-disclosure of your letter dated January 6, 2011. As of this date, we have not received your response to that request. In the interim, we received a request under the Freedom of Information Act (FOIA) for release of your letter. Based on its review, the NRC staff has determined that your letter can be released to the public.

Accordingly, the NRC staff proposes that your request for withholding disclosure of your letter regarding Ameren Missouri's "Response to September 17,2010 10 CFR 2.206 Petition Filed by Lawrence S. Criscione," is denied.

By separate correspondence, the Office of Information Services FOIA staff will formally advise you of the NRC staff's conclusion.
