S. Nuclear Regulatory Commission (NRC) which proposed an amendment to Renewed Operating License No. DPR-67 for St. Lucie Plant Unit I to increase the licensed core power level from 2700 MWt to 3020 MWt. (ML101160182).

By letter dated August 13, 2010, FPL withdrew the April 16, 2010 license amendment request and stated that it may re-submit a revised application at a future time (ML102290018).

The NRC acknowledged FPL's request to withdraw the April 16, 2010 license amendment request by letter dated August 13, 2010 (ML 102240195).

Additionally, the NRC provided supplemental information specifying the areas where additional information was required to enable the NRC staff to complete its detailed review of the application.

Pursuant to 10 CFR 50.90, FPL hereby re-submits a request for an amendment to Renewed Operating License No. DPR-67 for St. Lucie Plant Unit 1. The proposed LAR addresses the information requested in the enclosure to the NRC's letter to FPL dated August 13, 2010 pertaining to Spent Fuel Pool Criticality, Control Rod Withdrawal at Power, and Station Blackout (SBO) Coping Analysis.

Additionally, a summary of the substantive changes made to this LAR is provided in Enclosure I of this letter.an FPL Group company L-2010-259 Page 2 The proposed LAR will increase the licensed core power level of Unit I from 2700 MWt to 3020 MWt and revise the Renewed Operating License and the Technical Specifications to support operation at this increased core thermal power level. This represents a net increase in licensed thermal power of approximately 11.85% and includes a 10.0% extended power uprate and a 1.7% measurement uncertainty recapture (MUR). The net increase from the current core thermal power level is calculated as follows: (2700 MWt x 1.10) x 1.017% z 3020 MWt (3020 -2700 MWt) / 2700 MWt = 11.85%Therefore, this amendment is an Extended Power Uprate (EPU). The increase in core thermal power is currently planned to be accomplished mid-cycle, after the fall 2011 refueling outage.St. Lucie Unit I Amendment No. 48 dated November 23, 1981 (ML013530273)

-approved a Stretch Power Uprate from 2560 MWt to 2700 MWt. The proposed EPU core thermal power level represents an increase of approximatelyl 8 percent from the original licensed thermal power level of 2560 MWt.The proposed LAR was developed using the guidance provided in RS-001, "Review Standard for Extended Power Uprates," Revision 0, dated December 2003 as it applies to the design bases of St. Lucie Plant Unit 1. The proposed LAR was also developed consistent with the format and content contained in the R.E. Ginna Nuclear Power Plant for an EPU (ML051950123).

Plant modifications to support EPU are being implemented over time. A list of key plant modifications (plant changes) associated with the proposed EPU is provided in Attachment 5, Section 1.0.Attachment I contains the Descriptions and Technical Justifications for the changes to the Renewed Facility Operating License, Technical Specifications, and License Basis. In accordance with 10 CFR 50.91 (a)(1), FPL has completed a No Significant Hazards Consideration analysis and concludes that the changes proposed by this license amendment request present no significant hazards under the standards set forth in 10 CFR 50.92(c), and accordingly, a finding of"no significant hazards consideration" is justified.

FPL's No Significant Hazards Consideration analysis is included in Attachment 1.Attachment 2 contains the Supplemental Environmental Report. This report presents FPL's assessment of the environmental impacts associated with St. Lucie Units I and 2 EPU from the current licensed core rated power level of 2700 MWt to an updated core power level of 3020 MWt. This report demonstrates that the EPU will not significantly affect human health or the natural environment.

L-2010-259 Page 3 Attachment 3 contains the Renewed Facility Operating License, Technical Specifications Markups, and Clean Pages. This attachment is provided to facilitate identification of the proposed changes and retyped Operating License and Technical Specifications pages.Attachment 4 contains the Technical Specification Bases Markups. This attachment is provided as information only to facilitate identification of the proposed bases.Attachment 5 contains the Licensing Report (LR). The LR follows the guidance of RS-001. The LR demonstrates that the EPU can be safely achieved, and that the increase will not be inimical to the common defense and security or to the health and safety of the public. The LR provides the details supporting the requested power uprate, and is supported by the other attachments to the LAR to provide a comprehensive evaluation of the effects of the EPU. The LR is supported by nine appendices:

Appendix A -Safety Evaluation Report Compliance; Appendix B -Additional Codes & Methods; Appendix C-Realistic Large Break LOCA Summary Report with Zr-4 Fuel Cladding; Appendix D -List of Key Acronyms; Appendix E -Supplement to LR Section 2.4.1, Reactor Protection, Engineered Safety Features Actuation, and Control Systems; Appendix F -Caldon Ultrasonics Engineering Reports; AppendixG

-WCAP-! 7197-NP, Revision 0, St. Lucie Unit I RCS Pressure and Temperature Limits and Low-Temperature Overpressure Protection Report for 54 Effective Full Power Years; Appendix H -Grid Stability Analysis and System Impact Study for St. Lucie Plant with Proposed EPU; and Appendix I -Holtec Criticality Analysis Reports.Attachment 6 contains copies of the Proprietary Information Affidavits.

The purpose of this attachment is to withhold the proprietary information contained in the specified tables and appendices of the LR (Attachment

5) from public disclosure.

Attachment 5 contains information proprietary to Westinghouse Electric Company, LLC (Westinghouse), ArevaNP Inc. (Areva), Cameron International Corporation (Cameron), Holtec International (Holtec) and Babcock & Wilcox Canada Ltd. (B&W). Affidavits signed by Westinghouse, Areva, Cameron, Holtec and B&W as the owners of the information set forth the basis for which the information may be withheld from public disclosure by the Commission and address with specificity the considerations listed in paragraph (b)(4) of § 2.390 of the Commission's regulations.

(4) Pursuant to the provisions of paragraph (b)(4) of Section 2.390 of tle Commission's regulations, the following is furnished for consideration by the Commission in determining whether the information sought to be withheld from public disclosure should be withheld.(i) The information sought to be withheld from public disclosure is owned and has been held in confidence by Westinghouse.(ii) The information is of a type customarily held in confidence by Westinghouse and not customarily disclosed to the public. Westinghouse has a rational basis for determining the types of information customarily held in confidence by it and, in that connection, utilizes a system to determine when and whether to hold certain types of information in confidence.

The application of that system and the substance of that system constitutes Westinghouse policy and provides the rational basis required.Under that system, information is held in confidence if it falls in one or more of several types, the release of which might result in the loss of an existing or potential competitive advantage, as follows: (a) The information reveals tile distinguishing aspects of a process (or component, structure, tool, method, etc.) where prevention of its use by any of 3 CAW- 10-3007 Westinghouse's competitors without license from Westinghouse constitutes a competitive economic advantage over other companies.(b) It consists of supporting i data, inciuding test data, relative to a process (or conmponent, structure, tool, method, etc.), the application of which data secures a competitive economic advantage, e.g., by optimization or improved marketability.(c) Its use by a competitor would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, instal lation assurance of'quality, or licensing a similar product.(d) It reveals cost or price information, production capacities, budget levels, or commercial strategies of Westinghouse, its customers or suppliers.(e) It reveals aspects of past, present, or future Westinghouse or customer funded development plans and programs of potential commercial value to Westinghouse.(f) It contains patentable ideas, for which patent protection may be desirable.

There are sound policy reasons behind the Westinghouse system which inchlde the following: (a) The use of such information by Westinghouse gives Westinghouse a competitive advantage over its competitors.

It is, therefore, withheld from disclosure to protect the Westinghouse competitive position.(b) It is information that is marketable in many ways. The extent to which such information is available to competitors diminishes the Westinghouse ability to sell products and services involving the use of the information.(c) Use by our competitor would put Westinghouse at a competitive disadvantage by reducing his expenditure of resources at our expense.

4 CAW-10-3007 (d) Each component of proprietary information pertinent to a particular competitive advantage is potentially as valuable as the total competitive advantage.

If competitors acquire components of proprietary information, any one component may be the key to the entire puzzle, thereby depriving Westinghouse of a competitive advantage.(e) Unrestricted disclosure would jeopardize the position of prominence of Westinghouse in the world market, and thereby give a market advantage to the competition of those countries.(f) The Westinghouse capacity to invest corporate assets in research and development depends upon the success in obtaining and maintaining a competitive advantage.(iii) The information is being transmitted to the Commission in confidence and, under the provisions of 10 CFR Section 2.390; it is to be received in confidence by the Commission.(iv) The information sought to be protected is not available in public sources or available information has not been previously employed in the same original manner or method to the best of our knowledge and belief.(v) The proprietary information sought to be withheld in this submittal is that which is appropriately marked in Florida Power and Light's St. Lucie Unit I extended power uprate (EPU) submittal transmittal letter to the NRC, Attachment 5, Sections:

Pursuant to the provisions of paragraph (b)(4) of Section 2.390 of the Commission's regulations, the following is furnished for consideration by the Commission in determining whether the information sought to be withheld from public disclosure should be withheld.(i) The information sought to be withheld from public disclosure is owned and has been held in confidence by B&W.(ii) The information is of a type customarily held in confidence by B&W and not customarily disclosed to the public. B&W has a rational basis for determining the types of information customarily held in confidence by it and, in that connection, utilizes a system to determine when and whether to hold certain types of information in confidence.

The application of that system and the substance of that system constitutes B&W policy and provides the rational basis required.Under that system, information is held in confidence if it falls in one or more of several types, the release of which might result in the loss of an existing or potential competitive advantage, as follow: (a) The information reveals the distinguishing aspects of a process, component, structure, tool, method, etc., where prevention of its use by 2 any of B&W's competitors without license from B&W constitutes a competitive economic advantage over other companies.(b) It consists of supporting data, including test data, relative to a process (or component, structure, tool, method, etc.), the application of which data secures a competitive economic advantage, e.g., by optimization or improved marketability.(c) Its use by a competitor would reduce its expenditure of resources or improve its competitive position in the design, manufacture, shipment, installation, quality assurance, or licensing of a similar product.(d) It contains patentable ideas, for which patent protection may be desirable.

There are sound policy reasons behind the B&W system which include the following:

  • The use of such information by B&W gives B&W a competitive advantage over its competitors.

It is, therefore, withheld from disclosure to protect B&W's competitive advantage.

  • It is information which is marketable in many ways. The extent to which such information is available to competitors diminishes the B&W ability to sell products and services involving the use of such information." Use by a competitor of B&W would put B&W at a competitive disadvantage by reducing the competitor's expenditure of resources at B&W's expense.* B&W's capacity to invest corporate assets in research and development depends upon the success in obtaining and maintaining a competitive advantage.(iii) The information is being transmitted to the Commission in confidence and, under the provisions of 1OCFR Section 2.390, it is to be received in confidence by the Commission.(iv) The information sought to be protected is not available in public sources or available information has not been previously employed in the same original manner or method to the best of our knowledge and belief.(v) The proprietary information sought to be withheld in this submittal is that which is identified in Florida Power and Light's St. Lucie Unit 1 EPU submittal transmittal letter to the NRC, Attachment 5, Section 2.2.2.5 and Application for Withholding Proprietary Information from Public Disclosure, to the Document Control Desk.

3 The information which is proprietary in the proprietary version is contained within brackets, and where the proprietary information has been deleted in the non-proprietary versions, only the brackets remain (the information that was contained within the brackets in the proprietary versions having been deleted).The justification for claiming the information so designated as proprietary is indicated in both versions by means of lower case letters (a) through (d) located as a superscript immediately following the brackets enclosing each item of information being identified as proprietary.

These lower case letters refer to the types of information B&W customarily holds in confidence identified in Sections (4)(ii)(a) through (4 )(ii)(d) of this affidavit pursuant to 10 CFR 2.390(b)(1).
