BROWNS FERRY NUCLEAR PLANT, UNITS 1,2 AND 3, SEOUOYAH NUCLEAR PLANT, UNITS 1 AND 2, AND WATTS BAR NUCLEAR PLANT, UNITS 1 AND 2 - ACKNOWLEDGEMENT OF CYBER SECURITY PLANS SUPPLEMENTS BASED ON NEI 08-09, REVISION 6 (TAC NOS. ME4952, ME4953, ME4954, ME4955, ME4956, ME4951 and ME4958)
Dear Mr. Krich:
This is to acknowledge receipt of Tennessee Valley Authority (TVA or the licensee) letters dated July 23,2010 (Agencywide Documents Access and Management System (ADAMS)
Accession Nos. ML102090052 for BFN, ML102090027 for SON, and ML102090051 for WBN (non-public)), "Second Supplement to Request for Approval of the Browns Ferry Nuclear Plant Cyber Security Plan," 'Third Supplement to Request for Approval of the Sequoyah Nuclear Plant Cyber Security Plan," and "Second Supplement to Request for Approval of the Watts Bar Nuclear Plant Cyber Security Plan," which superseded in its entirety the Cyber Security Plans based on Nuclear Energy Institute (NEI) 08-09, Revision 3, dated November 23,2009 (ADAMS Accession Nos. ML093290207 for BFN, ML093290192 for SON, and ML093290051 for WBN (non-public)).
The Cyber Security Plans were resubmitted by letters dated JUly 23,2010, and are based on NEI 08-09, Revision 6, which the U.S. Nuclear Regulatory Commission (NRC) staff stated, in its letter dated May 5, 2010 (ADAMS Accession No. ML101190371). would be acceptable for use by licensees to comply with the requirements of Title 10 of the Code of Federal Regulations, Section 73.54, with the exception of the definition of "cyber attack."
Due to the re-submittal of the Cyber Security Plans, the Technical Assignment Control (TAC) numbers ME2707, ME2708, ME2706 (erroneously stated as ME2709 in a letter from NRC to TVA dated June 7, 2010, ADAMS Accession No. ML101450225" ME2680, ME2681, ME2677 and ME2679, associated with review of the prior NEI 08-09, Revision 3 Cyber Security Plans have been closed. TAC numbers referenced in the subject line will cover the review associated with the Cyber Security Plans based on NEI 08-09, Revision 6.

May 21,2010 for SON (ADAMS Accession No. ML101380162), and May 24,2010 for WBN (ADAMS Accession No. ML101390080), "the NRC staff has decided to forgo the traditional acceptance review due to the complexity and 'first-of-a-kind' nature of this application. While the NRC staff has docketed your applications, we are not rendering a judgment as to the acceptability of the submittals within the context of an acceptance review." TVA will be advised of any further information needed to support the NRC staff's detailed technical review by separate correspondence.
