MID-CYCLE PERFORMANCE REVIEW AND INSPECTION PLAN INDIAN POINT NUCLEAR GENERATING UNITS 2 AND 3
Dear Mr. Pollock:
On August 12, 2010, the Nuclear Regulatory Commission (NRC) staff completed its performance reviews of Indian Point Nuclear Generating Units 2 and 3. Our technical staff reviewed performance indicators (Pis) for the most recent quarter and inspection results for the period from July 1, 2009, through June 30, 2010. The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for future inspections at your facility.
This performance review and enclosed inspection plans do not include security information. A separate letter designated and marked as"Official Use Only--Security Information'will include the security cornerstone review and resultant inspection plan.
Plant performance for the most recent quarter at Indian Point Nuclear Generating Unit 2 was within the Licensee Response column of the NRCs Action Matrix based on all inspection findings being classified as having very low safety significance (Green) and all Pis indicating performance at a level requiring no additional oversight (Green). Therefore, we plan to conduct reactor oversight process (ROP) baseline inspections at Unit 2.
Plant performance, as of July 1, 2010, at Indian Point Nuclear Generating Unit 3 was within the Licensee Response column of the NRCs Action Matrix, based on all inspection findings being classified as having very low safety significance (Green) and all Pis indicating performance at a level requiring no additional oversight (Green). The Unit 3 "Unplanned Scrams per 7000 Critical HourS' PI exceeded the GreenNVhite threshold in the third and fourth quarters of 2009. The PI remained White through the first quarter of 2010 before returning below the GreenIWhite threshold in the second quarter of 2010. On April 23, 2010, the NRC staff completed a supplemental inspection in accordance with Inspection Procedure 95001, "Inspection for One or Two White Inputs in a Strategic Performance Area' at Indian Point Nuclear Generating Unit 3.
The inspectors concluded that your overall performance in the areas of problem identification, evaluation, and corrective actions with regards to the White PI was acceptable. Therefore, we plan to conduct ROP baseline inspections at Unit 3.
The enclosed inspection plans detail the inspections, less those related to physical protection, scheduled through December 31, 2011. The inspection plans are provided to allow for the resolution of any scheduling conflicts and personnel availability issues well in advance of

inspector arrival onsite. Routine resident inspections are not listed due to their ongoing and continuous nature. The inspections in the last nine months of the inspection plans are tentative and may be revised based on our end-of-cycle safety performance review.
In addition to the baseline inspection program at Units 2 and 3, we plan to conduct independent spent fuel storage installation inspections at Unit 2. Additionally, with regard to the replacement Alert and Notification System, the NRC plans to continue to monitor your activities to receive final approval from the Federal Emergency ManagE!ment Agency.
In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system {ADAMS}.
