ME3257 ME3258 ME3259 Indian Point Part 73 Exemption Request, Acceptance Review By letter dated January 28, 2010, Entergy Nuclear Operations, Inc. submitted an exemption request for Indian Point 1, 2 and 3. The redacted version of this document is publicly available from the Agencywide Documents Access and Management System as accession number ML100340142. The proposed exemption would allow the Indian Point site additional time to implement certain parts of the new physical security requirements of 10 CFR 73.55, "Requirements for physical protection of licensed activities in nuclear power reactors against radiological sabotage." The purpose of this email is to provide the results of the Nuclear Regulatory Commission (NRC) staff's acceptance review of this exemption request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to commence its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.
Pursuant to Section 73.5 of Title 10 of the Code of Federal Regulations (10 CFR), the applicant may request an exemption from the regulations of Part 73, and the NRC may grant such an exemption, provided the NRC determines it is authorized by law and will not endanger life or property or the common defense and security, and is otherwise in the public interest.
The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the NRC staff to commence its detailed technical review and make an independent assessment regarding the acceptability of the proposed exemption in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. You will be advised of any further information needed to support the NRC staff's detailed technical review by separate correspondence.
