SOUTH TEXAS PROJECT, UNITS 1 AND 2 - REQUEST FOR EXEMPTION FROM CERTAIN REQUIREMENTS OF REVISED FITNESS FOR DUTY RULE REGARDING MANAGING FATIGUE DURING SEVERE WEATHER CONDITIONS (TAC NOS. ME2259 AND ME2260)
Dear Mr. Halpin:
By application dated September 21, 2009 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML092720178), STP Nuclear Operating Company (STPNOC) requested the U.S.
Nuclear Regulatory Commission (NRC) approval of an exemption from certain requirements of the Fitness for Duty Programs rule regarding managing fatigue. Pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 26, Section 9, Specific exemptions, the STPNOC requested NRCs approval of an exemption from the requirements of paragraphs (c) and (d) of 10 CFR 26.205, Work hours, for meeting work hour controls requirements during declaration of severe weather conditions involving tropical storm or hurricane force winds.
By letter dated October 8, 2009 (ADAMS Accession No. ML092800455), the NRC staff informed the licensee that it supplement the application to address the additional information requirement outlined in the October 8, 2009 letter within 13 work days to enable the NRC staff to make an independent assessment regarding the acceptability of the proposed exemption in terms of regulatory requirements, and the protection of public health and safety and the environment. If the information responsive to the NRC staffs request was not received within 13 working days, the application would not be accepted for further review pursuant to 10 CFR 2.101, and the NRC staff will cease its review activities associated with the application.
By letter dated October 14, 2009, the licensee responded to the NRC staff's request, enclosing a submittal which included the requested supplemental information.
The NRC staff has reviewed the Licensees October 14, 2009 submittal, and concluded that the revised submittal does provide technical information in sufficient detail to enable the NRC staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the licensees request. If additional information is needed for the staff to complete its detailed technical review, you will be advised of it by separate correspondence.
