The referenced correspondence was submitted by the STP Nuclear Operating Company to request an exemption from certain requirements of the Fitness for Duty Rule for Managing Fatigue. This submittal is in response to a commitment that STPNOC was requested to make during a May 6, 2010 phone call with the Nuclear Regulatory Staff regarding information to maintain in site procedures.
The STPNOC commitment is provided in the Attachment to this letter. There are no other commitments in this submittal.

The following information will be maintained in site On approval of the 09-10811-9 procedures:
Request for Exemption
- 1. The conditions necessary to sequester site (NOC-AE-09002477) personnel that are consistent with the conditions specified in the exemption request (NOC-AE-09002477),
- 2. Provisions for ensuring that personnel who are not performing duties are provided an opportunity as well as accommodations for restorative rest, and
- 3. The condition for departure from the exemption is based on the Emergency Operations Facility Director's determination that adequate staffing is available to meet the requirements of 10 CFR 26.205(c) and (d).
1 The information is already in Revision 4 to the Hurricane Plan procedure. Upon approval of the Request for Exemption, the procedure will be revised to reflect that the inclusion of the information is a commitment to the Nuclear Regulatory Commission.
