SOUTH TEXAS PROJECT, UNITS 1 AND 2 - SUPPLEMENTAL INFORMATION NEEDED FOR ACCEPTANCE REVIEVV OF REQUESTED LICENSING ACTION RE: REQUEST FOR EXEMPTION FROM REQUIREMENTS OF REVISED 10 CFR 26.205 DURING SEVERE VVEATHER CONDITIONS (TAC NOS.
ME2259 AND ME2260)
Dear Mr. Halpin:
By application dated September 21, 2009 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML092720178), STP Nuclear Operating Company (STPNOC) requested the U.S. Nuclear Regulatory Commission (NRC) approval of an exemption from certain requirements of the Fitness for Duty Programs rule for managing fatigue. Pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 26, Section 9, "Specific exemptions,"
the STPNOC requested NRC's approval of an exemption from the requirements of paragraphs (c) and (d) of 10 CFR 26.205, "VVork hours," for meeting work hour controls requirements during declaration of severe weather conditions involving tropical storm or hurricane force winds.
The purpose of this letter is to provide the results of the NRC staff's acceptance review of this request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review.
The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements.
The NRC staff has reviewed your application and concluded that additional information is necessary to enable the staff to make an independent assessment regarding the acceptability of the proposed application in terms of regulatory requirements and the protection of public health and safety and the environment. Pursuant to 10 CFR 51.21, "Criteria for and identification of licensing and regulatory actions requiring environmental assessments," please provide an assessment of the environmental effects of the proposed exemption.
In order to make the application complete, the NRC staff requests that the applicant supplement the application to address the information requested above within 13 working days from the date of this letter. This will enable the NRC staff to begin its detailed technical review. If the information responsive to the NRC staff's request is not received within 13 working days, the application will not be accepted for further review pursuant to 10 CFR 2.101, and the NRC staff will cease its review activities associated with the application.
