FERMI 2 - RADIOLOGICAL EMERGENCY RESPONSE PREPAREDNESS PLAN CHANGES (TAC NO. MD5611)
Dear Mr. Davis:
By application dated May 14, 2007, as supplemented by letters dated February 5, February 7, August 22, and December 30, 2008 (Agencywide Documents Access and Management System (ADAMS) Accession Nos. ML071430159, ML080440121, ML080450337, ML082390034, and ML090070340, respectively) Detroit Edison submitted proposed changes to the Fermi 2 Radiological Emergency Response Preparedness (RERP) Plan in accordance with Title 10 of the Code of Federal Regulations (10 CFR) Section 50.54(q) for U.S. Nuclear Regulatory Commission (NRC) review and approval. The proposed changes would eliminate certain 30-minute and 60-minute augmented positions from the emergency response organization.
Regulatory Information Summary (RIS) 2005-002 discusses a decrease in effectiveness based on capability and functions and whether the capability to perform the functions that meet the emergency preparedness regulatory requirements have been lost or degraded. RIS 2005-002 provides a table with examples of plan changes that constitute a decrease in effectiveness; however, the examples in the table were not intended to be representative of all situations.
Additionally, page 4 of the RIS provides guidance for the licensee to evaluate the capability to perform the required functions and the associated time lines.
Based on review of the information provided, the NRC staff has concluded (reference ADAMS Accession Number ML091490081) that incorporation of the proposed changes would not decrease the effectiveness of the FERMI 2 RERP and the plan, as changed, continues to meet the standards in 10 CFR 50.47(b) and the requirements of Appendix E of 10 CFR Part 50. The licensee has maintained its capability to perform the duties and functions of each position that has been proposed to be eliminated. The licensee has instituted measures to reduce the impact on the ability to perform the functions for the extended time period. In light of the above, no NRC approval is necessary. It should be noted that the conclusion reached on these changes was based on this specific case and should not be considered to be applicable to other situations at this or other sites. NRC is preparing a revised RIS that will, among other things, provide additional guidance for determining whether a change constitutes a decrease in effectiveness.
