Dear Mr. Heflin:

By letter dated January 15, 2009 Union Electric Company (the licensee) requested the U.S.

Nuclear Regulatory Commission (NRC) staff for approval of a revision to Callaway Plant, Unit 1 Emergency Action Level (EAL) 6.1.

During a training session, the licensee determined that approved changes made in NEI 99-01 revision 5 to EAL SU 5 for an isolated relief valve had not been incorporated into the Callaway Plant EAL scheme during the review process. This EAL corresponds to Callaway EAL SU6.1.

The licensee's review has determined that this change requires a prior NRC approval, and has submitted the January 15, 2009 request for NRC action.

The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staff=s acceptance review of this request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed the application and concluded that it does provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed revision to EAL 6.1 in terms of regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the staff to complete its technical review, you will be advised of it by separate correspondence.
