SUMMARY

OF DECEMBER 11,2008, PERIODIC MEETING WITH FENOC STAFF ON LICENSING ACTION STATUS (TAC NOS. IV1D7069, MD7070, MD7093, AND MD7136)

On December 11,2008, a Category 1 public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives of FirstEnergy Nuclear Operating Company (FENOC, the licensee) at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The purpose of the meeting was to discuss the status of current and proposed licensing actions. A list of attendees is enclosed.

The licensee's presentation generally followed the information found in its handout (See Agencywide Documents Access and Management System (ADAMS) Accession No. ML083530435). The licensee provided an overview of the FENOC fleet regulatory affairs organization, including its roles and responsibilities, and also provided an overview of ongoing and future licensing actions. Among other things, the licensee discussed:

response to and planned future actions related to Generic Letter (GL) 2008-01, "Managing Gas Accumulation in Emergency Core Cooling, Decay Heat Removal, and Containment Spray Systems,"

  • status of license renewals within the FENOC fleet, National Fire Protection Association 805, "Performance-Based Standard for Fire Protection for Light Water Reactor Electric Generating Plants," transition plans,
  • status of Improved Standard Technical Specification (ISTS) implementation,
  • planned spent fuel storage licensing actions for the fleet, pending risk-informed licensing initiatives (compliance with Regulatory Guide 1.200),
  • GL 2004-02, "Potential Impact of Debris Blockage on Emergency Recirculation during Design Basis Accidents at Pressurized-Water Reactors," resolution, and planned site-specific licensing actions The licensee's presentation material provides additional detail about the discussion topics. The NRC staff clarified that the licensee does not plan to transition to NFPA-805 at the Perry Nuclear Power Plant, Unit NO.1 (PNPP), and that a project is underway at PNPP to provide for dry storage of spent fuel before 2011.

Among other things, the licensee and the NRC staff discussed the amount of time needed to complete the Davis-Besse Nuclear Power Station, Unit NO.1 ISTS conversion amendment request. The licensee stated that the conversion review exceeded its internal estimates by nearly three times. The licensee stated that the internal estimates were based on industry

- 2 averages of similar projects. The NRC staff explained that there were several beyond-scope items identified during the review that had to be evaluated in a manner similar to a traditional license change that might explain the higher-than-expected number of NRC staff review hours.

The participants also discussed the acceptance review process recently implemented by the NRC staff (NRR Office Instruction L1C-109). Generally, the NRC staff and the licensee agreed that process was well received by the industry and an improvement to the licensing action review process.

The NRC staff solicited feedback on a number of topics related to licensing activities, including the enhancements in the electronic distribution of public documents issued by the NRC staff, whether FENOC planned to transition to electronic submittals in the future, and the FENOC process for handling sensitive unclassified documents sent to the NRC. In general, FENOC has been pleased with the NRC staff's conversion to electronic distribution of documents. The licensee had no plans to change its document submittal process to an all electronic one, but listened to the NRC staff's explanation of the benefits to the licensing process and indicated that they may consider it in the future.

The participants generally agreed that the meeting was beneficial and agreed to hold similar meetings on a regular schedule.
