By letter dated October 3, 2008, R.E. Ginna Nuclear Power Plant, LLC submitted an ASME Code relief request for the R.E. Ginna Nuclear Power Plant (TAC No. MD9962). In addition, by application dated October 6, 2008, R.E. Ginna Nuclear Power Plant, LLC submitted the related license amendment that includes the reporting requirements of draft 10 CFR 50.61a (TAC No.
MD9967).
The NRC approved WCAP-16168-NP-A, Revision 2, "Risk-Informed Extension of the Reactor Vessel In-Service Inspection Interval," by letter dated May 8, 2008 (ADAMS Accession No. ML081060051). This WCAP provides for extension of the inservice inspection interval for certain pressure retaining welds in the reactor vessel from 10 to 20 years. Your letter of October 3, 2008, proposes to implement this extended inservice inspection interval at Ginna.
In the NRC approval of WCAP-16168-NP-A, Revision 2, the NRC required that licensees that do not implement 10 CFR 50.61a, must amend their licenses to require the submittal of the information and analyses requested in paragraph (e) of the final 10 CFR 50.61a (or the proposed 10 CFR 50.61a, as appropriate). Your application dated Octobe 6, 2008, included an amendment to your operating license to include these reporting requirements.
The purpose of this email is to provide the results of the Nuclear Regulatory Commission (NRC) staff's acceptance review of both the relief request and license amendment request. The acceptance reviews were performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance reviews are also intended to identify whether the applications have any readily apparent information insufficiencies in their characterization of the regulatory requirements or the licensing basis of the plant.
Consistent with Section 50.90 of Title 10 of the Code of Federal Regulations (10 CFR), an amendment to the license (including the technical specifications) must fully describe the changes requested, and following as far as applicable, the form prescribed for original applications. Section 50.34 of 10 CFR addresses the content of technical information required.
This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.
Pursuant to Sections 50.55a(a)(3)(i) and 50.55a(a)(3)(ii) of Title 10 of the Code of Federal Regulations (10 CFR), the applicant shall demonstrate that the proposed alternatives would provide an acceptable level of quality and safety, or that compliance with the specified requirements of Section 50.55a would result in hardship or unusual difficulty without a compensating increase in the level of quality or safety.
The NRC staff has reviewed both of your applications and concluded that they provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment and relief request in terms of regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
