TORNADO MITIGATION AND HIGH-ENERGY LINE BREAK (HELB) LICENSE AMENDMENT REQUESTS (LARS) FOR OCONEE NUCLEAR STATION (OCONEE), UNITS 1, 2, AND 3 (TAC NOS. MD9026, MD9027, MD9028, AND MD9029)

Dear Mr. Baxter:

By two letters dated June 26, 2008, you submitted LARS that propose revisions to the current licensing basis for tornados and HELBs outside containment. The LAR for the tornado licensing basis (Agencywide Document Access and Management System (ADAMS) accession number ML081840372) applies to the three Oconee units, while the LAR for the HELB licensing basis (ADAMS accession number ML081910559) applies only to Oconee Unit 1. In these letters, you stated that the safety analysis work is in progress relative to operation of the standby shutdown facility with a compromised main steam pressure boundary due to potential breaks in the main steam system. You stated that this analysis will be submitted on or before June 30, 2009.

With this analysis not included, these LARs do not meet the criteria for acceptance discussed in LIC-109, Acceptance Review Procedure (ML081200811). However, LIC-109 states, in certain rare circumstances, there may be situations where, although evaluation of an RLA

[request for license amendment] against the criteria would suggest one action, another action may be more appropriate, based on NRC staff recommendations to division management. We have concluded, for the reasons stated below, that these LARs meet the rare circumstances definition and therefore, should be accepted for review.

These two LARs address a number of modifications, including the installation of a new protected service water system (to be implemented by December 2010) and the installation of main steamline isolation valves (to be implemented by December 2012 for Unit 1, December 2014 for Unit 2, and December 2013 for Unit 3).

By beginning the review at this time, we will be able to provide you early feedback on the acceptability of these proposed changes to the licensing bases through requests for additional information, and teleconferences and meetings. In addition, if we do not accept these LARs for review and request that you resubmit them when they are complete (which would be on or before June 30, 2009), the schedule for implementation of the modifications, which are safety enhancements, could be impacted.
