Dear Mr. Conway:
By letter dated April 3, 2008, Pacific Gas and Electric Company, the licensee, submitted a license amendment request for Diablo Canyon Power Plant, Unit Nos. 1 and 2 (DCPP). The proposed amendment would revise Technical Specification (TS) 3.7.5, Auxiliary Feedwater System, to remove Surveillance Requirement 3.7.5.6, and revise TS 3.7.6, Condensate Storage Tank (CST) and Fire Water Storage Tank (FWST), to remove the FWST level requirements, revise the CST level requirements, and revise TS 3.7.6 to be consistent with the NUREG-1431 Standard Technical Specifications. The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this amendment. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review.
The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.
Consistent with Section 50.90 of Title 10 of the Code of Federal Regulations (10 CFR), an amendment to the license (including the technical specifications) must fully describe the changes requested, and following as far as applicable, the form prescribed for original applications. Section 50.34 of 10 CFR addresses the content of technical information required.
This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.
The NRC staff has reviewed your application and concluded that the information delineated in the enclosure to this letter is necessary to enable the staff to make an independent assessment regarding the acceptability of the proposed amendment request in terms of regulatory requirements and the protection of public health and safety and the environment.
In order to make the application complete, the NRC staff requests that PG&E supplement the application to address the information requested in the enclosure by June 20, 2008. This will enable the NRC staff to begin its detailed technical review. If the information responsive to the

Conway NRC staffs request is not received by the above date, the application will not be accepted for review pursuant to 10 CFR 2.101, and the NRC will cease its review activities associated with the application. If the application is subsequently accepted for review, you will be advised of any further information needed to support the staffs detailed technical review by separate correspondence.
The information requested and associated time frame in this letter were discussed with Mr. Ken Shrader of your staff on June 2, 2008.

IDENTIFICATION OF INFORMATION INSUFFICIENCY BY THE OFFICE OF NUCLEAR REACTOR REGULATION REGARDING CONDENSATE STORAGE TANK AMENDMENT REQUEST FOR DIABLO CANYON POWER PLANT, UNIT NOS. 1 AND 2 DOCKET NOS. 50-275 AND 50-323 By letter dated April 3, 2008, Pacific Gas and Electric Company, the licensee submitted a license amendment request (LAR) for Diablo Canyon Power Plant, Unit Nos. 1 and 2 (DCPP).
The proposed amendment would revise Technical Specification (TS) 3.7.5, Auxiliary Feedwater System, to remove Surveillance Requirement 3.7.5.6, and revise TS 3.7.6, Condensate Storage Tank (CST) and Fire Water Storage Tank (FWST), to remove the FWST level requirements, revise the CST level requirements, and revise TS 3.7.6 to be consistent with the NUREG-1431 Standard Technical Specifications. As part of the acceptance review process the NRC staff has concluded that the information delineated below is necessary to enable the NRC staff to make an independent assessment regarding the acceptability of the proposed amendment request in terms of regulatory requirements and the protection of public health and safety and the environment:
- 1) On page 2 of the LAR, the licensee states, The revised CST minimum storage usable volume calculations are being performed by PG&E under 10 CFR 50.59, and NRC review of the calculations is not being requested. The NRC staff request that this calculation and supporting documentationbe provided for our review as it is the basis for the revised CST minimum volume.
- 2) The licensee bases the TS change on the ability of the CST to hold an increased volume of water. The calculations or documentation supporting this premise is needed by the NRC staff for performance of this review. In particular, the NRC staff requests the licensee supplement the application with sufficient documentation and detailed analysis to justify how the CST usable volume has increased from 164,678 gallons to 220,600 gallons.
- 3) The LAR mentions modifications adding plenum inside the tank to raise the intake level for this piping in the event of a downstream pipe break, but does not explicitly address the concern of rupturing the non-seismic connections to the tank wall due to a seismic event. The licensee performed the modifications under 10 CFR 50.59. The NRC staff request that sufficient documentation and design calculations for this modification be provided for review. In addition to the design calculations, please include information regarding how the tank and piping connections were modified and explain by the seismic event, with the modification, will no longer render the necessary volume of water above the break unusable.
