H. B. ROBINSON STEAM ELECTRIC PLANT, UNIT NO. 2 WITHDRAWAL OF LICENSE AMENDMENT REQUEST FOR TECHNICAL SPECIFICATIONS CHANGES RELATED TO THE INTERLOCK FOR THE TURBINE TRIP INPUT TO THE REACTOR PROTECTION SYSTEM (TAC NO. MD7468)

Dear Mr. Walt:

By letter dated November 29, 2007 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML073380653), Carolina Power and Light Company, now doing business as Progress Energy Carolinas, Inc. (PEC), applied for an amendment to the H.B.

Robinson Steam Electric Plant, Unit No. 2 (HBRSEP), Facility Operating License No. DPR-23.

The proposed change would have modified the facility technical specifications pertaining to the interlock for the turbine trip input to the reactor protection system. Subsequently, by letter dated June 24, 2008 (ADAMS Accession No. ML081790165), PEC withdrew the amendment request.

The need to withdraw this amendment request was precipitated by a PEC determination during the outage planning process that the upcoming refueling outage scope needed to be reduced.

A nuclear condition report (NCR) has been initiated in the HBRSEP corrective action program that describes the circumstances associated with the withdrawal of this amendment request.

PEC stated in its June 24, 2008, letter that there is a possibility for resubmittal of this license amendment request at a future date. Accordingly, the U.S. Nuclear Regulatory Commission (NRC) staff will attempt to capture the efforts already completed relative to this issue, including retention of the response to a request for additional information included in the June 24, 2008, letter, and a draft safety evaluation that has already been completed by the NRC staff.

The purpose of this letter is to advise you that the above-cited application is being treated as withdrawn. Notice of Consideration of Issuance of the proposed amendment had not been published in the Federal Register. Please contact me at (301) 415-3178, if you have questions.
