JOSEPH M. FARLEY NUCLEAR PLANT, UNITS 1 AND 2 - GENERIC LETTER 2008-01, MANAGING GAS ACCUMULATION IN EMERGENCY CORE COOLING, DECAY HEAT REMOVAL, AND CONTAINMENT SPRAY SYSTEMS, RESPONSE TO EXTENSION REQUEST (TAC NOS. MD7825 AND MD7826)
Dear Mr. Johnson:
Generic Letter (GL) 2008-01 (Agencywide Documents Access Management System (ADAMS)
Accession No. ML072910759), Managing Gas Accumulation In Emergency Core Cooling, Decay Heat Removal, And Containment Spray Systems, requests licensees to submit information to demonstrate that the emergency core cooling, decay heat removal, and containment spray systems are in compliance with the applicable regulatory requirements, and that suitable design, operational, and testing control measures are in place for maintaining this compliance. The GL 2008-01 states that each licensee is requested to submit a written response within nine-months to provide requested information and that if a licensee cannot meet the requested nine-month response date, a three-month written response is required that describes the alternative course of action that it proposes to take, including the basis for the acceptability of the proposed alternative course of action.
By letter dated April 8, 2008 (ADAMS Accession No. ML081000362), you stated the following:
The NRC requested that if a licensee cannot meet the requested response date, the licensee shall provide a response within 3 months of the date of this GL.
Based on an April 7, 2008 telecon between Southern Nuclear Operating Company (SNC) Nuclear Licensing and Jared Wermiel of the U.S. Nuclear Regulatory Commission (NRC), a verbal approval for an extension of the three-month response was given and the new due date for the response is no later than May 30, 2008. The date extension for the response was requested and approved based on:
- The short time frame between receipt of the NEI three-month response template and the due date of the response.
- To allow the SNC plants time to identify the actions which will be completed both prior to and after nine-months from the issuance date of the generic letter.
- The three-month response will be submitted no later than May 30, 2008.
This letter is to formally acknowledge the approval of the requested extension to the due date for submitting the three-month response to GL 2008-01 and to document the telephone call(s) with the NRC staff. Specifically, you requested an extension for providing the above three-month response from April 11, 2008, to May 30, 2008, at Joseph M. Farley Nuclear Plant, Unit Nos. 1 and 2. The NRC staff finds that your justification to extend the due date for the three-month written response to GL 2008-01 is acceptable, and your extension request is granted. This letter does not alter or change the required nine-month response date of October 11, 2008. The NRC staff will evaluate your alternate plans (three-month response) for responding to GL 2008-01 after receipt and will respond appropriately.
