Dear Mr. Minahan:
By application dated November 19, 2007, as supplemented April 4, 2008, et al., Nebraska Public Power District (NPPD, the licensee) requested the U.S. Nuclear Regulatory Commission (NRC) staff approval of an amendment to the Cooper Nuclear Station facility operating license and technical specifications to increase the rated thermal power from 2381 to 2419 megawatts thermal (1.62 percent increase) based upon increased feedwater flow measurement accuracy to be achieved by using high accuracy ultrasonic flow measurement instrumentation. Your proposal is a measurement uncertainty recapture power uprate.
The NRC staff has reviewed the information provided in your supplement dated April 4, 2008, and determined that additional information is required in order to complete its review. The enclosed questions were discussed with D. Van Der Kamp, et al., of your staff on April 29, 2008.
Please provide a response to the enclosed questions by May 9, 2008.
The NRC staff considers that timely responses to requests for additional information help ensure sufficient time is available for staff review and contribute toward the NRCs goal of efficient and effective use of staff resources. OFFICE OF NUCLEAR REACTOR REGULATION REQUEST FOR ADDITIONAL INFORMATION RELATED TO MEASUREMENT UNCERTAINTY RECAPTURE POWER UPRATE REQUEST NEBRASKA PUBLIC POWER DISTRICT COOPER NUCLEAR STATION DOCKET NO. 50-298 The following are provided from the Instrumentation and Controls Branch (EICB) as follow-up questions to your April 4, 2008 letter:
- 1. Page 1 of Attachment 6 stated that the originally proposed 9.85% is incorrect, and you will revise the value to 9.84%. It seems that you calculated 10%/1.016 = 9.8425%, and rounded off the value to 9.84%. Since the Rod Worth Minimizer (RWM) blocks erroneous operation of a control rod at low power, should the permissive setpoint be 9.85% instead of 9.84%, to be more conservative?
- 2. In Attachment 1, you stated that the APRM Neutron Flux-High (Flow Biased) is a safety-limit-related limiting safety system setting, but that you would not use the guidance provided in the NRC to NEI letter dated September 7, 2005. The letter provided an acceptable means to the NRC staff of meeting the requirements of 10 CFR 50.36. If you will not use the guidance of the letter, you should provide another means acceptable to the staff, or the staff will be unable to determine that your proposed change meets the regulatory requirements.
