Dear Sir or Madam:
The purpose of this letter is to communicate the revision of a commitment made in Reference 1.
In that letter, the Nebraska Public Power District committed to the submittal of a Startup Test Report within 90 days following resumption of power operation following Refueling Outage 24 (RE-24). The Nuclear Regulatory Commission (NRC) reflected this commitment in the issuance of Amendment 231 in Reference 2. This commitment has been revised to submit a Startup Test Report to the NRC within 90 days following completion of the power uprate special test.
At the time the original commitment was made, the measurement uncertainty power uprate license amendment was anticipated prior to the conclusion of RE-24. The special test for power uprate would have been accomplished during power ascension. However, Amendment 231 was not granted until June 30, 2008, which delayed the completion of the special test. The intent of the original commitment was to provide the Startup Test Report 90 days or sooner from the completion of the special test. Based on the completion date of the special test, the revised commitment due date is October 23, 2008.
The due date of the original commitment was August 15, 2008. The missed due date and the need to revise the commitment has been discussed with the NRC Project Manager for Cooper Nuclear Station (CNS), and has been entered into the CNS corrective action program.
