RESOLUTION 2008-052 RESOLUTION OF THE.BOROUGH OF BARNEGAT LIGHT, COUNTY OF OCEAN, STATE OF NEW JERSEY, PETITIONING FEDERAL & STATE .REGULATORY AGENCIES TO. REQAtQE,_THE INSTALLATION. OF.

COOLING' TOWERS AS A PREREQUISITE TO THE 20-YEAR.. LICENCE RENEWAL FOR THE OYSTER CREEK NUCLEAR POWER PLANT..

WHEREAS, the 'Oyster Creek Nuclear Power Plant is located in Lacey Township across the Barnegat Bay from the Borough of Bamegat Light; and

-WHEREAS, the Barnegat Bay has-been designated as a part of the National Estuary Program to protect this v.aluable marine habitat;:and .

WHEREAS, the commercial fishing industry is a vifal industry in Bamegat Light, which supplies millions of pounds 'f fish as an imnportant food source for the United States and foreign food markets; and'.

WHEREAS, recreational fishing is also an important part, of area tourism and: the-enjoyment of the natural environment; and REAS, the Oyster-Creek Nuclear Power Plant is responsible for the death of tens of millions of fish, shrimp, crabs, herring, flounder, and other marine organisms vital to the food chain for marine life, area wildlife and human life; and WHEREAS, the Oyster Creek Nuclear Power:Plant uses massive quantities of water from natural waterways to cool its facilities, which in turn dispo'ses of highly heated water back into the environment at temperatures devastating to marine wildlife; and WHEREAS, te U.S. Clean Water Act requires the use of the best technology available to reduce the impact of nuclear plants on marine life; and state and federal agencies have strongly recommenced the use of cooling towers to minimize the damage to marine life caused by the Oyster Creek Nuclear Power Plant; and WHEREAS', the .Os'ter Creek "Nuciear Power Plant is presently in the process of renewing its 20-year license to operate its nuclear facilities; and WHREAS, it is the desire of 'the Mayor and Borough Council of the Borough of Barnegat Light to petition both federal and state agencies with jurisdiction over the Oyster Creek Nuclear Power Plant to require the addition of.cooling towers as part of the 20-year license renewal process for te Oyster CreekNuciea Power Plant.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Baregat Light, County of Ocean, State ofNew Jersey, as follows:

1. That the; Mayor & Boroug Council"of the Borough of Barnegat Light do hereby petition both federal and state agencies with jurisdiction over the Oyster Creek Nuclear Power Plant, including the U.S. Nuclear Regulatory Commission, the U.S. Environmental Protection Agency and the N.J.,Department of Environmental Protection, to require the addition of cooling towers as part: of the 20-year license:renewal process for the-Oyster Creek Nuclear Power Plant.
2. That ertified copies, of this, resolution shall be'forwardedto' the U.S. Nuclear
