  1. 0 7-196-.R A RESOLUTION OF THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF BERKELEY SUPPORTING THE PETITION FILED BY THE NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION CONCERNING THE RE-LICENSING OF THE OYSTER CREEK NUCLEAR POWER PLANT.

May 21, 2007 WHEREAS, the Nuclear Regulatory Commission ruled on February 26, 2007, that review of the potential effect of terrorism was not required to be considered in the re-licensing review of the Oyster Creek Nuclear Power Plant; and WHEREAS, the New Jersey State Department of Environmental Protection has filed a petition with the Third Circuit Court of Appeals, requesting that an analysis of the potential impact of a terrorist attack should be included in the re-licensing review; and WHEREAS, the recent arrest of six (6) individuals accused of plotting to attack Fort Dix underscores a potential terrorist attack against the Oyster Creek Nuclear Power Plant is more than theoretical, NOW, THEREFORE, BE IT RESOLVED that the Township Council of the Township of Berkeley, in the County of Ocean, State of New Jersey, hereby supports the New Jersey Department of Environmental Protection in its appeal of the Nuclear Regulatory Commission's decision not to consider the potential impact of a terrorist attack in the re-licensing review of the Oyster Creek Nuclear Power Plant; and be it further RESOLVED that a certified copy of the within Resolution be forwarded by the Township Clerk to the following:
