Agenda No. 25 RESOLUTION NO. 101 OF 2007 RESOLUTION MEMORIALIZING THE SENTIMENTS OF THE ORANGE COUNTY (NEW YORK) LEGISLATURE REQUESTING THE UNITED STATES CONGRESS TO PASS BILLS, S.

649 AND H.R. 994 REQUIRING THE NUCLEAR REGULATORY COMMISSION TO CONDUCT AN INDEPENDENT SAFETY ASSESSMENT OF THE INDIAN POINT NUCLEAR POWER PLANT.

WHEREAS, Entergy is the owner and operator of two nuclear power plants, Indian Point 2

("IP2") and Indian Point 3 ("IP3"), located in Buchanan, New York; and WHEREAS, the Nuclear Regulatory Commission ('NRC') is the federal regulatory agency overseeing, regulating and licensing of IP2 and IP3; and WHEREAS, legislation has been introduced in both Houses of the U.S. Congress, by Senator Hillary Rodham Clinton and Congressman John Hall, that mandates the NRC to conduct an independent safety assessment "equal in depth and breadth" to the 1996 independent safety assessment of the Maine Yankee Nuclear Power Plant, located near Bath, Maine; and WHEREAS, this Legislature is firmly committed to protecting our citizenry and believes that an independent safety assessment of the Indian Point Nuclear Power Plant would be in the best interests of all those residents who live within proximity of the plant.

NOW, THEREFORE, it is hereby RESOLVED, that the Orange County Legislature requests that Congress enact bill numbers S.649 and H.R. 994 that requires the Nuclear Regulatory Commission to conduct an Independent Safety Assessment of the Indian Point Nuclear Power Plant.

RESOLVED, that the Clerk of the Legislature be and is hereby authorized and directed to send a certified copy of this resolution to Hon. George W. Bush, President of the United States; Hon.

Charles Schumer and Hon. Hillary Rodham Clinton, United States Senators; Hon. John Hall, Hon.

Maurice Hinchey, Members of the United States Congress; members of the Nuclear Regulatory Commission & Region I Office Administrator and Entergy Corp. and to such other persons as the Clerk, in her discretion, may deem proper in order to effectuate the purpose of this Resolution.
