SUMMARY
OF FEBRUARY 27, 2007, MEETING TO DISCUSS TECHNICAL SPECIFICATIONS (TSs) AND LICENSING PLAN FOR FUTURE LICENSE AMENDMENT REQUEST (LAR) FOR DIGITAL UPGRADE TO REACTOR PROTECTIVE SYSTEM AND ENGINEERED SAFEGUARDS PROTECTIVE SYSTEM (RPS/ESPS) (TAC NOS. MD2471, MD2472, AND MD2473)
On February 27, 2007, the Nuclear Regulatory Commission (NRC) met with Duke (the licensee) to discuss the TSs and the licensing plan for a future LAR for a digital upgrade to RPS/ESPS.
Enclosed is a list of the attendees. The handouts provided by the licensee during the meeting are available in the Agencywide Documents Access and Management System under accession number ML070590252.
The licensee stated that it intends to retain separate TSs for RPS and ESPS and that it intends to retain one set of TSs that apply to all three units. However, since the implementation of the digital upgrade to RPS/ESPS will occur at different times for the three units, the TS changes will include a note that states that these changes apply after the digital upgrade has been implemented. The NRC staff did not state any objections to this approach.
The licensee also stated that it intends to request some TS changes, and provide the justification for these changes, in the future LAR. These changes include extending the Required Action Completion Times, eliminating the 12-hour channel check, and extending the functional test frequency.
The licensee is currently planning to submit the LAR by November 30, 2007, and presented a schedule that allowed only 1 year for the NRC staff to issue its safety evaluation (SE). The NRC staff indicated that issuing its SE within 1 year of receipt of the LAR would be a significant challenge.
On slide 13 of the handout entitled, Oconee Digital LAR Licensing Plan, the licensee listed the documents that will not be provided before the NRC staff completes its SE. The NRC staff stated that the licensee had previously indicated that some of these documents would be submitted prior to the completion of the NRC staffs SE. The NRC staff stated that some of these delayed documents would be important for the successful completion of the NRC staffs review and that further discussion and consideration regarding the submission of these documents is needed.

The licensee and the NRC staff agreed to have additional meetings and discussions prior to submission of the LAR. The licensee and the NRC staff agreed to meet in the near future to discuss cyber security and the quality management plan.
