REVIEW OF OYSTER CREEK LICENSE RENEWAL APPLICATION
Dear Mr. Goyette:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your latest letters to President Bush, dated August 25, 2006, which can be found in the Agencywide Documents Access and Management Support System (ADAMS) under Accession No. ML063240543, and me, dated October 4, 2006, (Accession No. ML063240547), concerning the NRC staff review of the Oyster Creek Nuclear Generating Station (Oyster Creek) license renewal application. In your letter to President Bush, you asked the President to remind the NRC of its primary focus, and stated that Relicensing should be denied. In your letter to me, you cited two key considerations: The Absence of a Realistic Evacuation Plan and Evidence that the Plants Discharge Waters are Harming The Environment. You stated that the NRC must be pursuing a hidden agenda and indicated that you have irrefutable proof that radiation from the plant has created deformed marine life.
In response to your letter to President Bush, dated February 21, 2006, (Accession No. ML061770450), I explained in a letter dated July 17, 2006, (Accession No. ML061930320),
the license renewal process and the status of associated ongoing litigation. I also, provided you links to the NRC website concerning license renewal and the Department of Energy website concerning the high-level waste repository at Yucca Mountain, Nevada.
In response to your letter to President Bush, dated July 2, 2006, (Accession No. ML062430537), I explained, in a letter dated October 10, 2006, (Accession No. ML062620470),
our mission of protecting public health and safety, and the NRCs regulatory responsibility for protecting against potential terrorist threats.
In response to your letter to me, dated August 25, 2006, (Accession No. ML062560021), I explained, in a letter dated October 10, 2006, (Accession No. ML062650288), how the NRC protects public health and safety, the reasons security and evacuation plans are outside the scope of license renewal, the opportunities for public citizens to participate in licensing hearings and in NRC reviews of license renewal applications, and the status of the NRC staff review of the Oyster Creek license renewal application. I also, provided you links to the NRC website containing the NRC Safety Evaluation Report with Open Items for Oyster Creek and the NRC draft Supplement Environmental Impact Statement for Oyster Creek.
R. Goyette Let me again assure you that the NRC takes its public health and safety mission and regulatory responsibilities very seriously. The NRC staffs review of the Oyster Creek license renewal application will determine whether the application satisfies applicable regulatory requirements.
No licensing decision will be made until that review is complete.
I appreciate your interest in the license renewal review process. However, it is apparent that the NRC staff is unable to address the concerns raised in your letters to your satisfaction.
Because you state that the NRC has a hidden agenda, I am forwarding your letters to the NRC Inspector General for his consideration. Dr. Michael Masnik, of my staff, will contact you regarding your concern about deformed marine life.
