REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (ELECTRIC POWER RESEARCH INSTITUTE)
Dear Mr. Marion:
By letter dated January 12, 2006, you submitted an affidavit dated December 8, 2005, executed by Mr. David J. Modeen of Electric Power Research Institute (EPRI), requesting that the EPRI documentation, "Materials Reliability Program: Primary System Piping Butt Weld Inspection and Evaluation Guideline (MRP-139)" be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Section 2.390. A nonproprietary version of MRP-139 was provided.
By letter dated April 20, 2006, the NRC informed you of its determination following review of the affidavit. The NRC stated that it did not believe the affidavit contained sufficient basis to justify that Sections 1.2, 5, and 6 of MRP-139 should be withheld from the public as proprietary. Our letter also indicated that, in accordance with 10 CFR 2.390(c), the information sought to be withheld will be placed in the NRC's Public Document Room 30 days after receipt of the NRC letter unless an amended affidavit was provided or the information requested to be withheld was withdrawn.
As noted in the April 20, 2006, letter, the NRC staff believes that MRP-139 has contributed to the basis for the NRC's regulatory approach to address primary water stress corrosion cracking in primary system piping butt welds, which will be publicly available. Subsequent to issuing the April 20, 2006, letter, the NRC staff began to consider information that can be provided to supplement the publicly available information in MRP-139 and the NRC's regulatory approach.
Based on this consideration, the NRC staff has determined that continued review of your January 12, 2006, request is warranted. As a result, you are not required to respond to our
April 20, 2006, letter at this time. The NRC will inform you of its determination regarding your request for withholding certain sections of MRP-139 from public disclosure within approximately two months.
