Meeting Report DATE: April 12, 2006 TIME: 8:30 a.m. - 11:30 a.m. (EST)

PLACE: U.S. Nuclear Regulatory Commission Two White Flint North 11545 Rockville Pike, Room T-8C1 Rockville, Maryland PURPOSE: Discuss Contents of Final Status Survey Reports and Procedures for Partial Site Release ATTENDEES: Refer to Attachment A BACKGROUND:

Consumers Energy (CE), owner of the Big Rock Point (BRP) facility, submitted its initial license termination plan (LTP) for the BRP site on April 1, 2003. In Section 1.4 of the LTP CE stated it would release part of the site - all land not needed for the independent spent fuel storage facility (ISFSI) - when remediation of the site was completed. CE now expects to complete site remediation in summer of 2006 and submit a request for partial site release by November, 2006.

DISCUSSION:

CE presented the current status of the site, the area it planned to retain as the ISFSI, and its planned final status survey report (FSSR) submittals. It plans to submit two types of final survey results: supporting surveys to demonstrate compliance with release limits within excavations, and final status survey reports of the property at final grade.

ACTIONS:

CE will:

- identify the description of the site as currently licensed.

- update its schedule for remedial activities and surveys.

The U.S. Nuclear Regulatory Commission (NRC) reviewed the draft survey results and made suggestions on contents and submittals. NRC will:

- determine when it will conduct confirmatory surveys, based on CEs schedule.

- advise CE on a preferred schedule for receiving FSSRs and conducting inspections.

- determine if a license amendment is required for the partial site release.
