ACKNOWLEDGEMENT LETTER FOR A YELLOW FINDING AND NOTICE OF VIOLATION (NRC INSPECTION REPORT 05000305/2005018);

KEWAUNEE POWER STATION

Dear Mr. Christian:

Thank you for your letter dated January 18, 2006, in response to the Notice of Violation for a finding issued on December 21, 2005. Your response stated that you concurred with the violation and significance determination process characterization of Yellow.

In your letter, you indicated that this violation does not reflect current performance at the plant.

You identified the causes of the violation included: lack of detail in design basis documentation regarding flooding, high energy line break, seismic, and tornado protection; weaknesses in design basis maintenance; lack of knowledge of design basis and fully effective processes for determining the significance of problems and resolution prioritization; lack of rigor in plant staff evaluation and resolution of problems; and, flaws in Kewaunees probabilistic risk assessment with respect to flooding risk. Your letter also provided information about corrective steps taken and the results achieved, including Kewaunees improvement initiatives (submitted to the NRC in a March 18, 2005, letter) and actions completed prior to restart of the plant. In a November 14, 2005, letter, you provided an update to the improvement initiatives and identified additional improvement initiatives to address underlying issues in the violation. Additionally, you stated that you plan to submit a license amendment request to clarify the flooding design basis for the plant in the first quarter of 2006.

Based on discussions between my staff and members of your staff, an Inspection Procedure (IP) 95002 supplemental inspection is scheduled to occur in May 2006.
