CLOSURE OF INVESTIGATION (OI 4-2004-032)

Dear Mr. Levine:

This refers to an investigation conducted by the NRC Office of Investigations (OI) regarding activities at the Palo Verde Nuclear Generating Station. OI initiated the investigation to determine if Arizona Public Service Companys Palo Verde Nuclear Generating Station willfully failed to provide complete and accurate information [related to Calculation 13-JC-SE-0201] to the NRC.

Based on the evidence developed during the investigation, the allegation that Palo Verde Nuclear Generating Station willfully failed to provide complete and accurate information to the NRC was not substantiated. The NRC previously documented a non-willful failure to provide complete and accurate information in NRC Integrated Inspection Report 05000528/2005004, 05000529/2005004, 05000530/2005004.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
