NINE MILE POINT NUCLEAR STATION, UNITS 1 AND 2 - CORRECTION TO SAFETY EVALUATION ISSUED PURSUANT TO COMMISSION ORDER EA-03-086 REGARDING REVISED DESIGN BASIS THREAT (DBT); AND REVISIONS TO PHYSICAL SECURITY PLAN, TRAINING AND QUALIFICATION PLAN, AND SAFEGUARDS CONTINGENCY PLAN (TAC NOS. MC2941 AND MC2942)
Dear Mr. Spina:
By letter dated October 28, 2004, the Nuclear Regulatory Commission (NRC) issued an administrative license change to the Nine Mile Point Nuclear Station, Units 1 and 2 (NMPNS)
Facility Operating Licenses (FOLs) (DPR-63 and NPF-69) to incorporate the reference to the recently revised physical security plans, training and qualification plans, and safeguards contingency plans. A copy of the NRC staffs safety evaluation (SE) with regard to the security plans for NMPNS was provided as Enclosure 2 to the letter.
In your November 12, 2004, letter, you identified 19 inconsistencies in the staffs SE. The NRC staff has concluded that 16 of the 19 inconsistencies required that corrections be made to the SE. In our December 10, 2004, correction letter we indicated that inconsistencies 9, 11, and 16 were not incorporated as requested. During subsequent discussion with your staff, it was agreed that inconsistencies 11 and 16 were not required to be corrected, but that inconsistency 9 should be corrected to accurately reflect your as-written security plan. The enclosed page provides the corrected page to be inserted into the October 28, 2004, SE.
The inconsistency clarified the SE with regard to statements made in the revised security plans.
The changes made to the SE did not affect the NRC staffs previous evaluation of the revised security plans.
