July 8, 2004 Mr. Christopher M. Crane President and Chief Nuclear Officer AmerGen Energy Company, LLC 4300 Winfield Road Warrenville, IL 60555 SUBJECT OYSTER CREEK NUCLEAR GENERATING STATION - DEFERRAL OF REVIEW OF LICENSING ACTIONS (TAC NOS. MB9636, MC9637, MC9638, AND MC9639)
Dear Mr. Crane:
The purpose of this letter is to inform you that review of your requests for relief conveyed by your letter of June 12, 2003 (AmerGen letter 2130-03-20180), as supplemented by your letter of February 18, 2004, is being deferred until the beginning of fiscal year 2005 (FY05) that starts October 1, 2004. The Nuclear Regulatory Commission is deferring review of these actions to support the review of security plan, safeguard contingency plan, and security personnel training and qualification plan changes, required by an April 29, 2003, Commission Order. I have discussed the deferral of this action with Mr. David Helker of your staff.
Please have a member of your staff inform me if circumstances change with regard to the impact on your ability to safely operate your facility as a result of the deferral of this action.
