Status of Non-NRC Regulatory Approvals License Transfer for R. E. Ginna Nuclear Power Plant ("Ginna Station")

Dear Mr. Clark:
We are writing to advise you that all required non-NRC regulatory approvals for the sale and transfer of Ginna Station from Rochester Gas and Electric Corporation to Constellation Generation Group, LLC have been received as of May 24, 2004, and that the parties are ready to proceed to closing, pending receipt of the final required regulatory approval-NRC License Transfer.
Accordingly, we respectfully request that you expeditiously process our License Transfer Application, dated December 16, 2003, to allow NRC approval to be granted as quickly as possible, and in any event by June 1, 2004, as we initially requested in our Application.
