Dear Mr. Venable:
The Commission has issued the enclosed Amendment No. 194 to Facility Operating License No. NPF-38 for the Waterford Steam Electric Station, Unit 3. The amendment consists of changes to the Technical Specifications (TSs) in response to your application dated September 12, 2003, as supplemented by letter dated April 22, 2004.
The amendment revises the TS to change the heater acceptance criteria contained in surveillance requirements 4.6.6.1d.5, 4.7.6.1d.3, and 4.7.7d.4, performed to verify that the heat dissipated by the heaters is within a given band, for the shield building ventilation, control room ventilation, and controlled ventilation area systems, respectively. The changes increase the upper limit of the acceptance criteria from rated capacity plus 5 percent to rated capacity plus 10 percent and without any change for the lower limit of the band of rated capacity minus 10 percent.
A copy of the related Safety Evaluation is enclosed. The Notice of Issuance will be included in the Commissions next biweekly Federal Register notice.

- 1. The Nuclear Regulatory Commission (the Commission) has found that:
A. The application for amendment by Entergy Operations, Inc. (EOI) dated September 12, 2003, as supplemented by letter dated April 22, 2004, complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commissions rules and regulations set forth in 10 CFR Chapter I; B. The facility will operate in conformity with the application, the provisions of the Act, and the rules and regulations of the Commission; C. There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commissions regulations; D. The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public; and E. The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commissions regulations and all applicable requirements have been satisfied.

- 2. Accordingly, the license is amended by changes to the Technical Specifications as indicated in the attachment to this license amendment, and paragraph 2.C.2. of Facility Operating License No. NPF-38 is hereby amended to read as follows:
- 2. Technical Specifications and Environmental Protection Plan The Technical Specifications contained in Appendix A, as revised through Amendment No. 194, and the Environmental Protection Plan contained in Appendix B, are hereby incorporated in the license. EOI shall operate the facility in accordance with the Technical Specifications and the Environmental Protection Plan.
- 3. This license amendment is effective as of its date of issuance and shall be implemented within 60 days from the date of issuance.

WATERFORD STEAM ELECTRIC STATION, UNIT 3 DOCKET NO. 50-382
1.0 INTRODUCTION
By application dated September 12, 2003, Agencywide Documents Access and Management System (ADAMS) Accession Number ML030671076, as supplemented by letter dated April 22, 2004, ADAMS Accession Number ML041180277, Entergy Operations, Inc. (the licensee),
requested changes to the Technical Specifications (TSs) for the Waterford Steam Electric Station, Unit 3. The supplement dated April 22, 2004, provided additional information that clarified the application, did not expand the scope of the application as originally noticed, and did not change the NRC staffs original proposed no significant hazards consideration determination as published in the Federal Register on October 14, 2003 (68 FR 59217).
The proposed amendment would revise the TSs to relax the heater acceptance criteria contained in surveillance requirements (SRs) 4.6.6.1d.5, 4.7.6.1d.3, and 4.7.7d.4 for the shield building ventilation, control room ventilation, and controlled ventilation area systems, respectively. These SRs are performed to verify the heat dissipated by the heaters is within a given band. The proposed changes increase the upper limit of the acceptance criteria from rated capacity plus 5 percent to rated capacity plus 10 percent.
Specifically, the proposed changes would revise:
Shield Building Ventilation System SR 4.6.6.1d.5, which currently states:
Verifying that the heaters dissipate 60 + 3.0, -6.0 kW [kilowatts] when tested in accordance with ANSI [American National Standards Institute] N510-1975.
Is changed to state:
Verifying that the heaters dissipate 60 + 6.0, -6.0 kW when tested in accordance with ANSI N510-1975.
Control Room Ventilation System - SR 4.7.6.1d.3, which currently states:
Verifying that the heaters dissipate 10 (+ 0.5, -1.0) kW when tested in accordance with ANSI N510-1975.
Is changed to state:
Verifying that the heaters dissipate 10 + 1.0, -1.0 kW when tested in accordance with ANSI N510-1975.
Controlled Ventilation Area System - SR 4.7.7d.4, which currently states:
Verifying that the heaters dissipate 20 + 1.0, -2.0 kW when tested in accordance with ANSI N510-1975.
Is changed to state:
Verifying that the heaters dissipate 20 + 2.0, -2.0 kW when tested in accordance with ANSI N510-1975.
2.0 REGULATORY EVALUATION
The staff finds that the licensee in section 5.1 of its submittal identified the applicable regulatory requirements. The regulatory requirements for which the staff based its acceptance are:
- Title 10 of the Code of Federal Regulations (10 CFR), Part 50 Appendix A General Design Criterion (GDC)-19, "Control Room." This requires the control room air conditioning system as a part of the overall control room design that provides a safe working environment.
- 10 CFR Part 50, Appendix A, GDC-19, "Containment Atmosphere Cleanup." This requires Systems to control fission products, hydrogen, oxygen, and other substances which may be released into the reactor containment shall be provided as necessary to reduce ... the concentration and quality of fission products released to the environment following postulated accidents to assure that containment integrity is maintained.
- Consistency with similar requirement of Administrative TS 5.5.11.e, Ventilation Filter Test Program, of NUREG -1432, Standard Technical Specifications Combustion Engineering Plants. The NUREG suggests a band of +/- 10 percent.
3.0 TECHNICAL EVALUATION
The NRC staff has reviewed the licensees request and has concluded that the proposed SR acceptance criteria of rated wattage +/- 10 percent is acceptable based on:
- 1. Since the lower SR limit is not being changed, the relative humidity of the incoming air will continue to be reduced to 70 percent or below and, therefore, the efficiency of the charcoal filter will not be adversely affected.
- 2. The proposed tolerance band does not impact the maximum air temperature, since the maximum air temperature is controlled (by thermostat) and will not reach the ignition temperature of the charcoal adsorber.
- 3. Since the lower limits of the SRs are not being changed, the proposed SR limits will not adversely affect the ability to detect a degraded heater since degradation is expected to be in the decreasing kilo-watts direction.
- 4. The emergency diesel generator (EDG) fuel oil consumption is not adversely affected.
- 5. The licensee, by its letter dated April 22, 2004, stated that the potential increase in electrical load was considered with respect to other loads that may be operating at more than nameplate rated values or at a service factor and adequately documented in the diesel load calculation EC-E90-006. Therefore, the EDG loading remains within the capability of the EDGs.
- 6. The relaxation of SRs is consistent with NUREG-1432, Standard Technical Specifications Combustion Engineering Plants.
4.0 STATE CONSULTATION
In accordance with the Commission's regulations, the Louisiana State official was notified of the proposed issuance of the amendment. The State official had no comments.
5.0 ENVIRONMENTAL CONSIDERATION
The amendment changes a requirement with respect to installation or use of a facility component located within the restricted area as defined in 10 CFR Part 20 and changes surveillance requirements. The NRC staff has determined that the amendment involves no significant increase in the amounts, and no significant change in the types, of any effluents that may be released offsite, and that there is no significant increase in individual or cumulative occupational radiation exposure. The Commission has previously issued a proposed finding that the amendment involves no significant hazards consideration, and there has been no public comment on such finding (68 FR 59217, dated October 14, 2003). The amendment also relates to changes in recordkeeping, reporting, or administrative procedures or requirements.
Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(9) and 10 CFR 51.22(c)(10). Pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendment.
6.0 CONCLUSION
The Commission has concluded, based on the considerations discussed above, that: (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commissions regulations, and (3) the issuance of the amendments will not be inimical to the common defense and security or to the health and safety of the public.
