Discuss Progress of the Management and Human Performance Team Inspection G. Wright discussed the status of his Management and Human Performance Team Inspection. Restart Checklist Items 1.a and 4.b were discussed for closure however, the RAM closure forms were not complete and the Panel deferred closure of these items pending review of the associated RAM closure forms.
NEW ACTION ITEM - B. Ruland to investigate how the NRC handled communication of potential inspection issues and findings during in-progress inspection work at Millstone in regards to their organization and human performance problems.

Discuss Plant Status and Inspector Insights and Emergent Issues List S. Thomas discussed plant status and inspector insights and emergent issues.

Discuss Action Items The Panel discussed the list of open action items. The Panel directed that Action items 54c, 127, 133, 154, 156, and 175 be closed due the actions being completed.
Item 54c -In relation to action item 54a - Assess method to ensure Technical Specifications are adequate for a cycle, administrative controls vs. amending technical specifications This Item to be addressed with Item 54a.
Item 127 - Decision of the extent of the needs for resolution of the technical root cause
Technical root cause discussed in Inspection Report 03-04 under closure of Restart Checklist Item 1.a.
Item 133 - 12/29 Taping of debate This action was not complete; however, Item 133 is no longer important.
Viewing the tape would not be of much use.
Item 136 - NRR acceptance of NOP criteria and method J. Grobe to send an email week of 05/19 with Panels question of whether the licensees method and criteria are adequate to address the TS for zero unidentified reactor coolant leakage from the reactor coolant system. By the end of the week of 05/19 NRR to formulate a proposed position for discussion. The position by NRR will be discussed by the Panel during the 05/27 0350-Panel meeting. After discussing on 05/27 the issue is to be presented internally within the NRC for dissenting views.
Item 154 - Marty followed up with licensee to understand licensees actions to address common mode failure issues (i.e., topical issues) and brief Panel. Then he developed an inspection plan to address topical issues Item 175 - LER licensee commitment on Containment Air Cooler Supplement for 01/31/03 Item 185 - Awaiting significance determination - feedback to HQ when the transport analysis is received from the licensee 4.
Discuss Adding an Action Item to Receive FEMAs Reply The Panel determined that no action item was needed as this is already addressed in the Process Plan.

Discuss 1st Quarter ROP Sample Assessment S. Thomas presented the 1st quarter ROP sample assessment. The Panel determined that the scope of the resident inspection conducted during the first quarter of CY 2003 was appropriate and reasonably consistent with ROP expectations. The ROP Sample Status for the first quarter of CY 2003 is included as an attachment to these minutes.
NEW ACTION ITEM - C. Lipa to discuss with T. Kozak removing Davis-Besse from the Operational Management Information Report (OMI).

Discuss New letter from Kucinich C. Lipa discussed a recent letter from Representative Kucinich regarding G. Wrights Management and Human Performance Safety Culture Phase 3 Inspection.
NEW ACTION ITEM - C. Lipa and T. Mendiola to prepare Questions and Answers (Qs and As) once the letter is issued to ensure consistent communications regarding how the NRC articulates issues to the public.

Discuss New Allegations M. Phillips mentioned that one new allegation will be discussed at the next Allegation Review Board meeting.

Discuss New/Potential Licensing Issues J. Hopkins mentioned that the licensee submitted a License Amendment Request (LAR) regarding use of the high pressure safety injection pumps during the upcoming NOP test. The LAR is posted on the public Davis-Besse web site.

Discuss Need for update of Inspection Schedule Letter The Panel discussed the need for an update to the March 31, 2003, inspection schedule letter.

This data reflects the we were one sample short 71111.05Q and 71111.11. Due to the special status of Davis-Besse as an 0350 plant, the resident staff focus was not on completing the ROP sample requirements, but to use the inspection procedures, in conjunction with W90086 (0350) and IP 93812 (resident special inspection of restart issues), to inspect the required activities to assess the licensee progress toward being able to restart the plant.
