UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION RAS 6487 DOCKETED 05/30/03 ATOMIC SAFETY AND LICENSING BOARD PANEL SERVED 05/30/03 Before Administrative Judges:

Ann Marshall Young, Chair Dr. Charles N. Kelber Lester S. Rubenstein In the Matter of Docket Nos. 50-369-LR, 50-370-LR, 50-413-LR, and 50-414-LR DUKE ENERGY CORPORATION ASLBP No. 02-794-01-LR (McGuire Nuclear Station, Units 1 and 2, Catawba Nuclear Station, Units 1 and 2) May 30, 2003 ORDER (Regarding June 18, 2003, Meeting on GSI-189, and Deadline to Report to Licensing Board)

On May 22, 2003, Counsel for the NRC Staff advised the Licensing Board and all parties in this proceeding, which concerns Duke Energy Corporations application to renew the operating licenses for Units 1 and 2 of its McGuire Nuclear Station and Units 1 and 2 of its Catawba Nuclear Station, of a June 18, 2003, meeting with stakeholders about the resolution of GSI-189.

Given that since early on in this proceeding the parties have often referred to GSI-189 in their oral and written arguments on Amended Contention 2, currently under consideration by the Board, and given that the purpose of the June 18 meeting is [t]o discuss the NRC staff plans for resolution of GSI-189 . . . , the Board considers it appropriate to encourage all parties to attend this meeting, and to consider and communicate with each other about the possibility of settlement with regard to Amended Contention 2 based upon any information forthcoming from the June 18 meeting.

2 The parties shall notify the Board whether resolution of this contention appears to be a reasonable possibility, as well as of any other new developments arising out of the meeting, by June 25, 2003; if an extension of this deadline appears appropriate based on the parties communications, such shall be requested prior to the June 25 deadline.

The parties should draw no conclusions about the Boards inclinations on its ruling on Amended Contention 2 from any part this Order.

It is so ORDERED.
