RIVER BEND STATION, UNIT 1 - WITHDRAWAL OF GENERAL ELECTRIC COMPANY PROPRIETARY REPORT NEDC-33051P, REVISION 0, MAY 2002, AND NON-PROPRIETARY REPORT NEDC-33051, REVISION 0, MAY 2002, (TAC NO. MB5094)

Dear Mr. Stramback:

By letter dated May 14, 2002, Entergy Operations, Inc. (EOI) submitted General Electric Company (GE) Proprietary Report NEDC-33051P, "Safety Analysis Report for River Bend Station Thermal Power Optimization," (TSAR) dated May 2002, and requested that it be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Section 2.790. A nonproprietary copy of this document, NEDC-33051, transmitted by letter dated July 9, 2002, was placed in the U.S. Nuclear Regulatory Commission (NRC) Public Electronic Reading Room.

The NRC reviewed your request and the supporting documentation in accordance with 10 CFR 2.790, and concluded that there was not sufficient justification to make a determination to withhold this information from the public. Therefore, your request was denied, as indicated by my letter to you dated October 2, 2002.

In your letter dated November 1, 2002, you requested that both versions of the TSAR submitted by EOI be withdrawn.

Pursuant to your requests, NRC has properly disposed of all internal working copies of the subject material and removed the TSARs from the Public Electronic Reading Room, as well as all NRC internal access. Also, pursuant to the requirements in 10 CFR 2.790(c), the original documents received by NRC are being returned to GE separately.
